我国农村饮用水安全的法律保障——以环境正义价值及其制度构建为进路的分析

【摘要】：在城乡二元结构背景下,由于农村饮用水安全法律保障的正义价值迷失和制度缺位,农村饮用水安全已经成为我国经济、社会快速发展过程中需要解决的一个突出的环境问题和社会问题。破解农村饮用水安全法律保障存在的现实难题,需要以环境正义价值建构为基础,并通过尊重农民获得安全饮用水的平等权利,赋予农民获得安全饮用水的知情权、参与权等程序性法律权利,强化农村饮用水安全的环境行政法律监管,以及建立农村饮用水安全保障的经济机制等措施,推动农村饮用水安全的法律制度保障。
[Abstract]:Under the background of dual structure between urban and rural areas, rural drinking water safety has become the economy of our country because of the loss of the justice value of the legal guarantee of rural drinking water safety and the absence of the system. A prominent environmental and social problem needs to be solved in the process of rapid social development. To solve the practical problem of rural drinking water safety legal guarantee, we need to build the value of environmental justice as the foundation, and give farmers the right to know about safe drinking water by respecting the equal rights of farmers to obtain safe drinking water. The procedural legal rights such as participation rights, strengthening the environmental administrative and legal supervision of rural drinking water safety, and establishing the economic mechanism of rural drinking water safety guarantee are measures to promote the rural drinking water safety legal system guarantee.
