张家界生态旅游资源的法律保护对策研究

【摘要】：随着中国加入WTO,人民生活质量的提高,旅游业已成为一种蓬勃发展的新兴产业,世界遗产旅游已在旅游产业中占有重要份额。旅游业的发展也给当地旅游资源保护带来了巨大压力,并在一定范围内造成了开发与保护的不协调,资源破坏,环境恶化,生态平衡等问题比较突出。旅游业素有“无烟工业”之称,旅游活动是依托资源与环境而开展起来的。当前我国仍为发展中旅游开发模式,人们对旅游与环境之间的关系缺乏科学理解,生态旅游的发展也大部分停留在初级阶段,强调对旅游资源的开发而忽视旅游本身对环境的影响和资源的破坏。因此,积极依法发展生态旅游,要注意符合当地生态旅游特征,获取经济效益的同时也应当使社会效益和生态效益双丰收,关注民生工程,为区域经济的发展提供契机。要通过完善生态旅游法律、法规,既要保护生物资源,也要能改善生态环境,为当地居民增加就业岗位,提高居民的法律保护素质,增强社会大众环境保护的参与意识等,凸显出生态旅游法律、法规效益的综合性和时间性。以张家界生态旅游资源为例,本文从对生态旅游资源的认识入手,从法学、社会学、经济学、国际法的角度,通过分析张家界生态旅游资源在开发利用、可持续发展、公众参与和预防过程中的法律保护现状,深入研究其法律保护的途径和对策,从而推动张家界生态旅游经济在法律保护下健康、持续、稳定发展,推动生态旅游资源保护与经济文化的和谐发展。
[Abstract]:With China's entry into WTO and the improvement of people's quality of life, tourism has become a booming new industry, and the world heritage tourism has occupied an important share in the tourism industry. The development of tourism also brings great pressure to the protection of local tourism resources, and causes the incoordination between development and protection, the destruction of resources, the deterioration of environment, the ecological balance and so on. Tourism is known as "smoke-free industry", tourism activities are carried out based on resources and environment. At present, China is still developing tourism development mode, people lack scientific understanding of the relationship between tourism and environment, and the development of ecotourism is mostly in the primary stage. It emphasizes the exploitation of tourism resources and neglects the impact of tourism itself on the environment and the destruction of resources. Therefore, to develop ecotourism according to law, we should pay attention to the characteristics of local ecotourism, obtain economic benefits and make social and ecological benefits double harvest, pay attention to people's livelihood projects, and provide an opportunity for the development of regional economy. Through the improvement of laws and regulations on ecotourism, it is necessary not only to protect biological resources, but also to improve the ecological environment, increase employment posts for local residents, improve the legal protection quality of residents, and enhance the participation consciousness of the general public in environmental protection. Highlight the ecological tourism laws, laws and regulations of the comprehensive and temporal nature. Taking Zhangjiajie eco-tourism resources as an example, this paper starts with the understanding of eco-tourism resources, from the angles of law, sociology, economics and international law, through the analysis of Zhangjiajie eco-tourism resources in the development and utilization, sustainable development. The current situation of legal protection in the process of public participation and prevention, and the in-depth study of the ways and countermeasures of its legal protection, so as to promote the healthy, sustainable and stable development of the ecotourism economy in Zhangjiajie under the protection of the law. Promoting the harmonious development of ecotourism resources protection and economy and culture.
