【摘要】： 本文针对我国固体废弃物污染环境防治的严峻形势和现状,在讨论了固体废弃物污染环境防治的特殊性基础上,在相关法律制度层面运用比较研究、历史研究等研究方法对该论题进行了分析,确立了生产者责任组织的法学理论基础,通过借鉴外国生产者责任组织在固体废弃物污染环境防治的优点和长处,拟提出在该领域,建立以生产者责任组织法律制度为核心制度的生产者责任延伸制度,并提出了相应的立法完善建议。本文的研究成果在于较为全面、系统的参照了发达国家如德国、日本、荷兰和瑞士等国在固体废弃物污染环境方面运用强调生产者的主体地位,运用生产者责任组织的现状和发展趋势,总结了其特点,并引入了笔者对于该制度在中国设立的可行性及必要性思考。在分析总结国外经验的基础上,本文立足国情与实际,富于建设性的提出了将生产者责任组织划归于各行业协会运作和管理的大胆设想,并分析了可行性和合理性。而且,在法律制度设计方面,兼顾了国内该领域立法的缺陷和不足,提出了相应的立法建议,并在制度内容方面,提出了本文的见解。本文的局限在于对外文文献资料的把握和搜集较为陈旧,所反映的内容不能完全符合实际理论研究的需要；同时,鉴于本文作者的水平,本文所提出的观点难免有些缺失。
[Abstract]:In view of the severe situation and present situation of environmental pollution prevention and control of solid waste in China, this paper discusses the particularity of environmental prevention and control of solid waste pollution, and applies comparative research on the level of relevant legal system. Historical research and other research methods have analyzed the topic, established the legal theory foundation of producer responsibility organization, and proposed in this field by referring to the advantages and advantages of foreign producer responsibility organizations in the prevention and control of environmental pollution caused by solid waste. This paper establishes the extended system of producer responsibility based on the legal system of producer responsibility organization, and puts forward some suggestions on how to perfect the legislation. The research results of this paper are more comprehensive, systematically referring to developed countries such as Germany, Japan, the Netherlands and Switzerland, which emphasize the dominant position of producers in the pollution of the environment by solid waste. Using the current situation and development trend of producer responsibility organization, this paper summarizes its characteristics, and introduces the author's thinking on the feasibility and necessity of setting up this system in China. On the basis of analyzing and summing up the experience of foreign countries, this paper, based on the situation and reality, puts forward the bold idea of classifying the producer responsibility organization into the operation and management of various trade associations, and analyzes the feasibility and rationality. Moreover, in the aspect of legal system design, the defects and shortcomings of domestic legislation in this field are taken into account, and the corresponding legislative suggestions are put forward, and the views of this article are put forward in terms of the content of the system. The limitation of this paper lies in the fact that the foreign literature and materials are old and the contents can not completely meet the needs of practical theoretical research. At the same time, in view of the level of the author of this paper, it is inevitable that there are some deficiencies in the viewpoints put forward in this paper.
