海洋环境行政指导制度困境及对策研究

【摘要】： 海洋是人类的生存与发展的重要物质基础之一,海洋资源与环境的可持续利用与保护关系到人类的前途与命运。海洋环境问题的存在,客观上要求政府加强对海洋环境的管理;而政府所具有的行政权威及广泛的信息网络,也决定其在海洋环境管理中必定发挥更大的作用。只要适度,政府的作用是不可替代的。在社会主义市场经济条件下,企业转换经营机制成为市场的主体,政府转变职能成为市场经济宏观调控的主体。环境行政指导即是适应这样趋势的环境行政管理手段之一,具备优于传统强制性管理手段的特点,在我国的海洋环境管理中发挥着重要作用。海洋环境行政指导在我国出现于20世纪70年代末80年代初。虽然起步较晚,但却应用广泛,海洋环境行政指导与我国的海洋环境法制构成一种刚柔并济的关系,是我国海洋环境法制建设的重要补充。但就目前的情况看,还缺乏系统化、标准化和法治化,加上长期以来计划经济体制的影响,导致海洋环境行政指导在实践中还存在者许多问题。本文结合中外理论与实践,分析了目前我国海洋环境指导制度存在的问题,并针对问题提出对策,以期能够为我国的环境行政指导制度理论的发展与完善贡献绵薄之力。全文共分为五个部分;即海洋环境问题与海洋环境行政指导;海洋环境行政指导制度的兴起;海洋环境行政指导制度的基础理论;中国海洋环境行政指导制度的实践及困境;完善中国海洋环境行政指导制度的对策。最后是文章结论。
[Abstract]:The ocean is one of the important material bases for the survival and development of human being. The sustainable utilization and protection of marine resources and environment are closely related to the future and destiny of human beings. The existence of marine environmental problems objectively requires the government to strengthen the management of marine environment, and the administrative authority and extensive information network of the government also decide that it will play a greater role in the management of marine environment. As long as appropriate, the role of the government is irreplaceable. Under the condition of socialist market economy, the enterprise transformation management mechanism becomes the main body of the market, and the government transformation function becomes the main body of the market economy macro-control. Environmental administrative guidance is one of the environmental administrative means to adapt to such a trend. It has the characteristics of superior to the traditional mandatory management means and plays an important role in the marine environmental management of our country. The administrative guidance of marine environment appeared in the late 1970s and early 1980s in China. Although it started late, it is widely used. The relationship between the administrative guidance of marine environment and the legal system of marine environment in China is a kind of strong and soft relationship, which is an important supplement to the construction of legal system of marine environment in China. However, in the present situation, the lack of systematization, standardization and rule by law, coupled with the impact of the planned economic system for a long time, has led to many problems in the practice of the administrative guidance of the marine environment. Based on the theory and practice at home and abroad, this paper analyzes the existing problems of marine environmental guidance system in China, and puts forward some countermeasures in order to contribute to the development and perfection of the theory of environmental administrative guidance system in China. The full text is divided into five parts: the marine environment problems and the marine environment administrative guidance, the rise of the marine environment administrative guidance system, the basic theory of the marine environment administrative guidance system, the practice and the predicament of the Chinese marine environment administrative guidance system; Countermeasures for perfecting the Administrative guidance system for China's Marine Environment. Finally, the conclusion of the article.
