【摘要】： 湿地是陆生生态系统和水生生态系统之间的过度带,是地球上最重要生态系统之一,也是人类最重要的生存环境之一,是人类和地球的生命之源。湿地,由于对人类、对自然的特殊、重要之意义,其保护和合理利用问题越来越受到全球范围的普遍关注。如何合理利用湿地,如何正视湿地资源的破坏和不合理利用给人类已带来的惨重后果,如何针对湿地资源面临的现实,尽快完善我国的湿地资源保护的专门法律法规,这些都是摆在面前迫切需要解决的问题。健全和完善中国湿地保护的法律责任是十分重要的,也是非常必要的。湿地法律责任是湿地立法问题中必不可少的重要组成部分,是湿地保护最强有力的手段,也是保证湿地法律法规得以有效实施、以遏制湿地违法行为的重要保证。基于这种认识,本文试图从中国湿地保护的法律责任问题角度出发,对关于破坏湿地的民事、刑事、行政法律责任问题进行研究,并提出了有关建立健全湿地的损害赔偿制度以及对完善我国有关湿地法律责任立法的思考。
[Abstract]:Wetland is a transitional zone between terrestrial ecosystem and aquatic ecosystem. It is one of the most important ecosystems on the earth and one of the most important living environment for human beings. It is also the source of life for human beings and the earth. Wetland, because of its special and important significance to human being and nature, has been paid more and more attention to the protection and rational utilization of wetland. How to make rational use of wetlands, how to face up to the destruction and unreasonable utilization of wetland resources, and how to perfect the special laws and regulations of wetland resources protection in our country as soon as possible, in view of the reality of wetland resources, These are the urgent problems that need to be solved in front of us. It is very important and necessary to perfect and perfect the legal responsibility of wetland protection in China. Wetland legal liability is an essential part of wetland legislation, the most powerful means of wetland protection, and it is also an important guarantee to ensure the effective implementation of wetland laws and regulations in order to curb wetland illegal behavior. Based on this understanding, this paper attempts to study the civil, criminal and administrative legal liability for wetland destruction from the perspective of legal liability for wetland protection in China. It also puts forward some thoughts on how to establish and perfect the damage compensation system of wetland and how to perfect the legislation on the legal liability of wetland in our country.
