我国循环经济激励制度的法律思考

【摘要】：20世纪90年代以来,在国际上循环经济被广泛认可为实施可持续发展战略的重要途径。西方国家相继发展循环经济,建立循环经济社会。我国在借鉴发达国家成功经验上,也建立了一套适合本国需要的循环经济发展战略并得到了有效实施。但是,我国循环经济的发展不管在理论还是实践上,都相对落后发达国家,使循环经济得到有效的发展还需要多方的努力。目前,我国发展循环经济过程中重约束惩罚、轻激励,激励制度的运用明显不足。因此在借鉴国外运用激励手段促进循环经济经验上,结合我国国情,完善我国循环经济激励制度,由以往单独依靠政府的办法,转变为综合运用经济、法律、技术的办法并落到实处。运用完善的激励制度,推进循环经济发展,实现经济发展方式的绿色转变。提高资源利用效率,减少资源、能源消耗和污染物、废弃物的产生,促进环境、经济和社会全面、协调、可持续发展,实现两型社会。本文主要从法律的视角对我国当前循环经济激励制度相关理论、实施现状和发展趋势进行了深入的研究。对循环经济的相关理论进行了评述,探讨了我国循环经济激励制度的发展现状并进行了评价,综合分析发达国家的成功经验,对我国循环经济激励制度的建设提出了自己的观点和建议。全文除了导言部分以外,主要分为三大部分: 首先,文章通过对循环经济基本评析引出对循环经济激励制度内容的概述,分析了国内外学者对循环经济激励制度的各方看法及笔者意见,论述了循环经济激励制度的意义及存在的必要性和重要性。其次,文章主要介绍了国内外关于循环经济激励制度的研究现状,重点介绍了德国、美国、日本等发达国家的循环经济激励制度,从中找出促进我国循环经济激励制度发展的经验。另外文章概述了我国循环经济激励制度的发展及所取得的阶段性成果,同时分析了其中存在的问题。最后,该部分是文章的主体,在结合我国具体国情的基础上,笔者提出我国应该对《循环经济促进法》的名称重新进行修订,将《循环经济促进法》更改为《循环经济法》。同时文章还介绍了建议增设税收条目、充分发挥价格制度、调整金融制度、实行绿色投资,设立循环经济基金会增加财政支持等多种制度。另外通过鼓励循环经济技术研发和开展绿色教育的方式来健全非经济制度体系并健全法律责任,保证循环经济激励制度能够顺利实施。
[Abstract]:Since 1990's, circular economy has been widely recognized as an important way to implement sustainable development strategy. Western countries have developed circular economy and established circular economy society. In reference to the successful experiences of developed countries, China has also established a set of circular economy development strategies suitable for its own needs and has been effectively implemented. However, the development of circular economy in China is relatively backward in both theory and practice. At present, in the process of developing circular economy in China, the application of restraint punishment, light incentive and incentive system is obviously insufficient. Therefore, in drawing lessons from the experience of foreign countries in promoting circular economy by means of incentives, combining the situation of our country and perfecting the incentive system of circular economy in our country, we have changed from relying on the government alone in the past to making comprehensive use of economy and law. The technical approach is put into practice. Use perfect incentive system, promote the development of circular economy, realize the green transformation of the mode of economic development. Improve resource utilization efficiency, reduce resource, energy consumption and pollutant, waste generation, promote environmental, economic and social comprehensive, coordinated, sustainable development, achieve a two-type society. From the perspective of law, this paper makes a deep research on the theory, implementation and development trend of the incentive system of circular economy in China. This paper reviews the relevant theories of circular economy, probes into the present situation and evaluation of the incentive system of circular economy in China, and synthetically analyzes the successful experiences of developed countries. The author puts forward his own views and suggestions on the construction of circular economy incentive system in China. In addition to the introduction, the full text is divided into three main parts: First of all, through the basic analysis and analysis of circular economy, the article gives an overview of the incentive system of circular economy, and analyzes the views of scholars at home and abroad on the incentive system of circular economy and the author's opinion. This paper discusses the significance, necessity and importance of circular economy incentive system. Secondly, the article mainly introduces the research status of circular economy incentive system at home and abroad, focusing on the circular economy incentive system of Germany, the United States, Japan and other developed countries. Find out the experience of promoting the development of circular economy incentive system in China. In addition, the article summarizes the development of the circular economy incentive system and the achievements of the stage, and analyzes the existing problems. Finally, this part is the main body of the article. On the basis of the concrete situation of our country, the author puts forward that our country should revise the name of "Circular economy Promotion Law" again, and change the "Circular economy Promotion Law" to "Circular economy Law". At the same time, the article also introduces some systems, such as adding tax items, giving full play to price system, adjusting financial system, carrying out green investment, setting up circular economy foundation to increase financial support and so on. In addition, by encouraging the R & D of circular economy technology and developing green education, we can perfect the system of non-economic system, perfect the legal responsibility and guarantee the smooth implementation of the incentive system of circular economy.
