建设项目环评报告书审批中的听证制度研究

【摘要】:建设项目环评报告书的审批是环保部门一项重要的行政许可权,诸多案例表明,听证制度的引入能够促进该权力的合法合理地行使,有助于将公众的环境权利、政府的行政权力、社会的环境权益相统一。本文从《环境影响评价法》、《环境保护行政许可听证暂行办法》、《环境影响评价公众参与暂行办法》等现行规定分析入手,以“圆明园环评听证案”、“北京西-上-六环评听证案”等案件为现实基础,对我国建设项目环评报告书审批中的听证制度进行研究。 文章首先从听证的概念入手,阐述了建设项目环评报告书审批中的听证概念,特点及其意义,为之后的论述铺垫了必要的理论基础。然后,按照听证的时间顺序,分别论述了建设项目环评报告书审批听证前的准备机制、听证中的进行机制与听证后的回应机制。听证前准备机制的构建分别从听证的启动、听证代表的选择、听证主持人的选任等三个角度,评析现实案例,分析现有法律规定不足,探索了听证强制启动机制的建立,听证代表人选择与听证主持人选任的原则与程序的完善。听证中进行机制的构建主要着眼于听证议题、质辩程序与听证坐席布局三个重点环节。提出了要借助于预备听证会、书面证言规则等确定出听证的关键议题,借鉴法庭审判程序完善听证的质证制度和辩论制度,以程序正义的观念建立起合理的听证会坐席布局。在听证后回应机制的构建上,要以案卷排他性为原则,明确听证笔录在作出行政许可决定时的法律效力,同时,要在许可机关、申请人、利害关系人发现新证据的情况下,建立再听证制度,要在听证程序违法的情况下,建立救济的途径与方法。
[Abstract]:The examination and approval of the EIA report of construction projects is an important administrative license right of the environmental protection department. Many cases show that the introduction of the hearing system can promote the lawful and reasonable exercise of this power and help to bring the environmental rights of the public into practice. The administrative power of the government and the environmental rights and interests of the society are unified. This paper begins with the analysis of the current regulations, such as the Environmental impact Assessment Law, the interim measures for the hearing of Environmental Protection Administrative Licensing, and the interim measures for Public participation in Environmental impact Assessment, and takes the "Old Summer Palace Environmental impact Assessment hearing case" as a starting point. The hearing system in the examination and approval of environmental impact assessment report of construction projects in China is studied on the basis of the case of "Beijing West-Shang-6 EIA hearing case" and other cases. This paper begins with the concept of hearing, expounds the concept, characteristics and significance of hearing in the examination and approval of construction project environmental assessment report, which lays the necessary theoretical foundation for the later discussion. Then, according to the time order of the hearing, the paper discusses the preparation mechanism before the hearing, the mechanism of carrying out the hearing and the response mechanism after the hearing. The construction of pre-hearing preparation mechanism from the three angles of hearing initiation, hearing representative selection, hearing moderator selection and appointment, analyzes the actual cases, analyzes the insufficiency of the existing legal provisions, and explores the establishment of the hearing compulsory start mechanism. The selection of hearing representative and the perfection of the principle and procedure of the selection and appointment of the hearing moderator. The construction of the mechanism in the hearing mainly focuses on the issues of the hearing, the quality of the debate procedure and the layout of the hearing seat. The paper puts forward that the key issues of the hearing should be determined by means of the preparatory hearing and written testimony rules, the cross-examination system and the debate system of the hearing should be perfected by the trial procedure of the court, and a reasonable seat layout of the hearing should be established with the concept of procedural justice. In the construction of the response mechanism after the hearing, the principle of exclusiveness of the case file should be taken to make clear the legal effect of the record of the hearing in making the administrative license decision. At the same time, when the licensing authority, the applicant, the interested person discover the new evidence, To establish the system of re-hearing, we should establish the way and method of relief under the circumstance of illegal hearing procedure.
