【摘要】：近年来,为了满足经济发展的需要,各地进一步加强电力建设和投资力度,作为国民经济基础的电力产业取得了长足的进步和发展,但随之也引起了大量触电侵权纠纷,其中高压触电损害赔偿案件的损害后果最为严重,引起的社会关注度最高。但此类案件由于法律规定笼统,法条间存在冲突,在法律的适用和责任认定上都存在争议。往往案情相似的案件,因法官对无过错责任、免责事由和过失相抵等责任认定和责任限制条款的理解不同,有的案件判处侵权行为人承担小部分责任或不承担责任,有的判处侵权人承担主要责任,赔偿金额相差数十万甚至上百万。文章将重点分析高压触电案件的损害赔偿责任限制,期望能减少和降低此类案件判罚的任意性,在各当事人之间合理的分配法律责任。文章分为三个部分:第一部分是高压触电损害赔偿及其基本的法律问题,具体包括分析高压触电与高度危险责任的关系,高压触电损害赔偿责任主体的认定,以及我国触电损害赔偿的相关法律制度,以期理清案件处理中一些基本的法律关系和法律问题。第二部分将介绍高压触电损害赔偿的责任承担,包括高压触电损害赔偿的责任构成要件,高压触电损害赔偿中的无过错责任,以及根据原因力大小进行责任的认定的方式。第三部分是文章的重点,主要讨论高压触电人身损害案件的责任限制,分析高压触电事故的不可抗力、受害人故意等抗辩免责事由,讨论多因致损时如何结合受害人以及第三人过错,运用过失相抵规则,在当事人之间做好责任认定。
[Abstract]:In recent years, in order to meet the needs of economic development, all localities further strengthen the power construction and investment, as the basis of the national economy, the electric power industry has made considerable progress and development, but it has also caused a large number of electric shock infringement disputes. Among them, the damage consequence of high-voltage electric shock damage compensation case is the most serious, and the social concern is the highest. However, due to the general provisions of the law, there are conflicts between the provisions of the law, and disputes exist in the application of the law and the determination of liability. In cases where the case is similar, due to the judge's understanding of the liability determination and limitation clauses, such as no-fault liability, exemption from liability and negligence offset, some cases have sentenced the tortfeasor to bear a small part of the responsibility or not to bear the responsibility. Some have sentenced infringers to bear the main responsibility, the difference in compensation amounts hundreds of thousands or even millions. This paper will focus on the analysis of the limitation of liability for damages in high-voltage electric shock cases in order to reduce and reduce the arbitrariness of such cases and reasonably distribute legal liability among the parties concerned. The article is divided into three parts: the first part is the compensation for high voltage electric shock damage and its basic legal issues, including the analysis of the relationship between high voltage electric shock and high risk liability, the identification of the subject of compensation for high voltage electric shock damage. And the related legal system of electric shock damage compensation in China, in order to clear up some basic legal relations and legal problems in the handling of cases. The second part will introduce the liability of high voltage electric shock damage compensation, including the constitutive requirements of high voltage electric shock damage compensation, the non-fault liability in the high voltage electric shock damage compensation, as well as the way of determining the liability according to the force of reason. The third part is the focal point of the article, mainly discusses the limitation of liability in the case of personal injury caused by high voltage electric shock, analyzes the force majeure of the accident of high voltage electric shock, the defense reason of victim's intention and so on. This paper discusses how to combine the fault of the victim and the third party and how to use the fault offset rule to identify the liability between the parties.
