海洋油污损害中的纯粹经济损失赔偿研究

【摘要】：近些年来,对纯粹经济损失的研究逐渐进入我国学者的视野中,成为研究的热门话题,纯粹经济损失有其独特的概念和处理机制,导致纯粹经济损失的原因多种多样,目前,学界倾向于对纯粹经济损失做类型化研究,习惯将其分为四个种类：反射性损失；转移性损失；对错误信息、建议和专业服务的信赖所导致的损失；公共资源损害所致损失。其中公共资源损害所致损失这一种类型因其侵害范围广,受害人数多,损害后果严重,法律关系复杂而成为诸类型中的难点,而这一种类型的典型代表——海洋油污损害中的纯粹经济损失的赔偿随着我国石油开采、运输的发展,石油泄漏事故的频发以及人们维权意识的提高而突显对其研究的重要性和紧迫性。本文将从比较法的研究视野出发,以德、法、英、美以及国际油污基金组织对海洋油污损害中纯粹经济损失的赔偿处理模式为基础进行研究,同时对我国目前有关海洋油污损害中纯粹经济损失赔偿问题的相关立法和司法实践活动中的存在的问题予以分析,以期对我国建立起对这一损失的更好的处理模式提出有益的建议。本文除前言和结语部分外,共有三章。第一章：对纯粹经济损失的概念及分类进行了较为细致的分析,进而引出对海洋油污损害中纯粹经济损失这一问题的介绍；第二章：比较分析大陆法系国家和普通法系国家及国际油污基金组织对海洋油污损害中纯粹经济损失赔偿问题的处理模式。第三章：分析我国在处理海洋油污损害事故时,对海洋油污损害中纯粹经济损失赔偿问题的相关立法及司法实践中处理这一问题时所面临的窘境,并对此提出几点建议。
[Abstract]:In recent years, the study of pure economic loss has gradually entered the field of view of Chinese scholars and has become a hot topic of research. Pure economic loss has its unique concept and processing mechanism, which leads to a variety of reasons for pure economic loss. At present, the academic community tends to type the pure economic loss into four types. Category: loss of reflection; loss of transfer; loss of false information, advice and trust of professional services; loss caused by damage to public resources. Loss caused by public resource damage. The type of loss caused by public resource damage is a difficult problem in various types because of its wide range of infringes, many victims, serious consequences and complex legal relations. The typical representative of this type, the pure economic loss in the marine oil pollution damage, highlights the importance and urgency of the research with the development of oil exploitation, transportation, the frequent occurrence of oil leakage accidents and the improvement of people's consciousness of safeguarding rights.
From the perspective of comparative law, this paper will study the compensation treatment model of pure economic loss in marine oil pollution damage based on the study of Germany, France, Britain, the United States, the United States, and the international oil pollution fund, and the related legislation and judicial practice of the present problems concerning the compensation for pure economic loss in China's marine oil pollution damage. The problem is analyzed in order to provide useful suggestions for our country to establish a better mode of dealing with this loss.
In addition to the preface and the concluding part, there are three chapters in this paper.
The first chapter is a detailed analysis of the concept and classification of pure economic loss, and then leads to the introduction of the pure economic loss in the marine oil pollution damage.
The second chapter is to compare and analyze the treatment mode of the compensation for pure economic loss in the marine oil pollution damage by the civil law countries and the common law countries and the international oil pollution fund organizations.
The third chapter is to analyze the dilemma faced by the relevant legislation and the judicial practice to deal with the problem of the compensation for pure economic loss in the marine oil pollution damage, and put forward some suggestions on this.
