中国湿地保护法律制度评析

【摘要】： 湿地是全球重要生态系统,具有重要的经济功能和生态功能。保护湿地是国际社会的共识。本文系统梳理了湿地保护法律制度体系,从国际法角度梳理《湿地公约》及相关国际环境条约的有关湿地保护的主要内容,从国内法角度梳理出我国湿地保护的相关法、地方立法等内容。在此基础上,对我国湿地保护的国际法、国内法进行评价分析,阐述了国内法存在的问题,得出我国湿地法制保护缺乏系统性、原则性、效率性、应罚性的结论,并结合国外湿地立法经验,提出有针对性的调整意见,从湿地保护的法理基础、主要原则、国际条约的履行、法制执行力的强化、营建湿地保护司法环境、制定综合性湿地保护法等角度阐述了自己的观点。
[Abstract]:Wetland is an important ecosystem in the world, which has important economic and ecological functions. The protection of wetlands is a consensus of the international community. This paper systematically combs the legal system of wetland protection, combs the main contents of the Convention on Wetlands and related international environmental treaties from the angle of international law, and combs out the relevant laws of wetland protection in China from the angle of domestic law. Local legislation, etc. On this basis, the international law and domestic law of wetland protection in our country are evaluated and analyzed, and the problems existing in domestic law are expounded, and the conclusion is drawn that the legal protection of wetland in our country lacks systematization, principle, efficiency and punishment. Combined with the experience of foreign wetland legislation, the author puts forward some suggestions for adjustment, including the legal basis, the main principles, the implementation of international treaties, the strengthening of legal enforcement, and the construction of wetland protection judicial environment. Formulated comprehensive wetland protection law and so on the angle elaborated own viewpoint.
