生态文明视野下城市居住社区环境法律制度研究

【摘要】：生态文明是一种崭新的文明形式,它是人类社会与生产力水平发展到一定时期的必然产物,它正在改变的人类的行为方式,也正在改变人类的伦理观念。法律与人类行为和伦理观念也一直相互影响着,所以在生态文明的指导下,法律法规的内容也随着这些变化开始了自身的调整。本文选择了城市居住社区作为切入点,因为城市居住社区是社会的一个重要组成部分,它承担着对于人类来说非常重要的作用——居住。人类大部分的生产生活活动都是围绕着居住开始的,城市居住社区是与人类关系最为密切的一个区域,并且它也是整个社会一个缩影。所以城市居住社区的环境法治问题也间接的反映了整个社会的环境法治问题,并且我国设立了使“生态文明观念在全社会牢固树立”的目标,这时城市居住社区作为社会一个基础,其在这个历史时期的重要性将是不言而喻的。全文分为五章,第一章主要介绍生态文明与城市居住社区的基本理论,包括生态文明与城市居住社区的概念,并通过介绍城市居住社区的产生与发展揭示城市居住社区内出现的环境问题。最后简述了城市居住社区在生态文明的视野下与环境保护的关系。第二章简要介绍了国外相关城市居住社区环境法律制度的情况。笔者以英国伦敦、美国纽约、日本东京,这三个各有特色的城市为例,叙述了各城市中的相关环境法律制度,并分别对其进行了简单的评析。第三章介绍了我国城市居住社区环境法律制度的内容。笔者首先从环境与资源保护与社区管理两个方面介绍了我国城市居住社区内与其相关的法律制度。之后对我国城市居住社区内相关的法律制度进行了综述,指出了他们的缺失与不足。第四章与第五章从城市居住社区法律规定的内容、执行与监督三个方面加以评析,并分别提出了相应的建议,并从国外借鉴适合我国国情的经验与制度,完善我国城市居住社区环境法律制度,加快社区生态文明建设,在全社会牢固树立生态文明观念。
[Abstract]:Ecological civilization is a new form of civilization, it is the inevitable outcome of the development of human society and productivity level to a certain period, it is changing the way of human behavior, but also changing human ethics. Law, human behavior and ethics have always influenced each other, so under the guidance of ecological civilization, the contents of laws and regulations have begun to adjust themselves with these changes. This paper chooses the urban residential community as the starting point, because the urban residential community is an important part of the society, which plays a very important role for human beings-living. Most of the production and life activities of human beings begin around the residence. The urban residential community is a region with the closest relationship with human beings, and it is also a microcosm of the whole society. Therefore, the environmental rule of law in urban residential communities also indirectly reflects the environmental rule of law in the whole society, and our country has set up the goal of making the concept of ecological civilization firmly established in the whole society. At this time, as a social foundation, the importance of urban residential community in this historical period will be self-evident. The first chapter introduces the basic theories of ecological civilization and urban residential community, including the concept of ecological civilization and urban residential community. By introducing the emergence and development of urban residential communities, the environmental problems in urban residential communities are revealed. Finally, the relationship between urban residential communities and environmental protection in the view of ecological civilization is briefly described. The second chapter briefly introduces the legal system of the environment of the residential community in foreign cities. Taking London, New York and Tokyo, Japan, as examples, the author narrates the relevant environmental legal systems in each city and makes a brief analysis of them. The third chapter introduces the content of the legal system of urban residential community environment in China. Firstly, the author introduces the legal system of urban residential communities in China from the aspects of environment and resource protection and community management. Then it summarizes the relevant legal system in the urban residential communities and points out their deficiencies. The fourth and fifth chapters comment on the contents of the legal provisions of the urban residential community, the implementation and supervision of the three aspects, and put forward corresponding suggestions, and draw lessons from the experience and system suitable for the national conditions of our country from abroad. Improve the legal system of urban residential community environment, accelerate the construction of community ecological civilization, and firmly establish the concept of ecological civilization in the whole society.
