我国环境领域公众参与之法律探析

【摘要】：公众参与是可持续发展的一项重要措施,我国环境领域内公众参与却处于困顿之中。我国学界对环境领域内公众参与概念的理解普遍存在扩大化倾向,而对其权利本质有所忽略;环境领域公众参与权具有宪政内涵,环境权不应被视为其理论和实践基础;我国目前环境领域公众参与权的法律制度不健全,尤其在相关法律法规制定上存在缺陷;环境信息公开、非政府组织的发展、环境公益诉讼及环境教育等相关法律制度方面的问题与完善对于环境领域内公众参与权的实现具有举足轻重的影响。
[Abstract]:Public participation is an important measure of sustainable development. The understanding of the concept of public participation in the field of environment in our country has the tendency to expand, but the essence of the right is ignored, the right of public participation in the field of environment has constitutional connotation, and the right of environment should not be regarded as its theoretical and practical basis. At present, the legal system of public participation right in the field of environment is not perfect in our country, especially in the relevant laws and regulations, the environmental information is open, the development of non-governmental organizations, Environmental public interest litigation and environmental education and other related legal system issues and improvement of the environmental field of public participation in the realization of the right to play a decisive role.
