中国—东盟自由贸易区环境法律问题研究

【摘要】：近年来,中国与东盟交往频繁,双边贸易额逐步增长,经贸合作关系不断深化,合作领域持续扩大。目前,中国—东盟自由贸易区已正式启动,然而,随着自由贸易区经济合作的深化,环境问题也在扩大。所谓的环境问题是指由于人类活动或自然原因使环境条件发生不利于人类的变化,以影响人类的生产、生活给人类带来灾害的现象。为此,针对东盟国家的环境问题,通过环境合作的手段,加强中国—东盟自由贸易区环境法律制度的构建与研究,有利于我们正确的处理贸易与环境的关系,正确对待贸易过程中出现的环境问题。本文以中国—东盟自由贸易区的环境法律问题为研究对象,从环境法的角度通过“提出问题—分析问题—解决问题”的研究方法,为构建中国—东盟自由贸易区环境法律制度,提出自己的观点。除前言与结语外,论文分为五章。本文的第一章是“提出问题”部分,该部分内容是自由贸易区与环境问题。首先,对自由贸易区的含义以及中国—东盟自由贸易区界定及法律基础进行阐述。其次,提出了自由贸易区所面临的环境问题,并从经济学、法学的角度探讨了贸易与环境摩擦及协调手段,第一章的内容为提出论点提供背景与理论支撑。第二章属于“分析问题”部分,该部分的内容是中国—东盟自由贸易区环境问题分析,从环境问题的表现入手阐述自由贸易区出现环境问题的原因。第三、四、五章是解决问题部分。第三章的内容是解决环境摩擦的法律依据,此处的法律依据包括成员国的环境法律、多边环境协定以及贸易环境措施。最后得出的结论是：成员国国内环境法以及与贸易有关的环境措施不足以解决自由贸易区面临的环境问题,中国—东盟自由贸易区需要一部专属的环境法律。第四章北美自由贸易区与欧盟政策及启示,以北美自由贸易区、欧盟自由贸易区的环境政策为对象,剖析了北美自由贸易区、欧盟自由贸易区环境政策的体系、特点并在制度领域、环境合作领域得出启示。第五章构建中国—东盟自由贸易区环境法律,是本文最后的落脚点,强调环境合作的重要性,从构建的基础理论、构建原则、模式、环境合作四个方面提出自己的设想与建议。本文的主要论点是正确处理自由贸易区内出现的环境问题,单单依靠成员国的国内法以及多边的环境协定是不够的,需要加强环境领域的合作,建立一部中国—东盟自由贸易区的环境法律,并围绕如何建构这一环境法律,提出了意见与建议。
[Abstract]:In recent years, China and ASEAN have had frequent exchanges, bilateral trade volume has gradually increased, economic and trade cooperation has been deepened, and areas of cooperation have continued to expand. At present, China-ASEAN Free Trade area has been officially launched, however, with the deepening of economic cooperation, environmental problems are also expanding. The so-called environmental problems refer to the phenomenon that the environmental conditions are unfavorable to human beings because of human activities or natural reasons, in order to affect the production of human beings and bring disasters to human beings. Therefore, aiming at the environmental problems of ASEAN countries, strengthening the construction and research of the environmental legal system of China-ASEAN Free Trade area through the means of environmental cooperation will help us correctly deal with the relationship between trade and environment. Correctly deal with the environmental problems arising in the course of trade. This paper takes the environmental law problem of China-ASEAN Free Trade area as the object of study, from the angle of environmental law, through the research method of "posing question-analyzing problem-solving problem", in order to construct the environment law system of China-ASEAN Free Trade area. Put forward one's point of view. In addition to the preface and conclusion, the paper is divided into five chapters. The first chapter of this paper is "ask questions", this part is free trade area and environmental problem. First, the meaning of free trade area and the definition and legal basis of china-ASEAN free trade area are expounded. Secondly, it puts forward the environmental problems that the free trade area faces, and probes into the trade and environment friction and coordination means from the angle of economics and law. The content of the first chapter provides the background and theoretical support for putting forward the argument. The second chapter belongs to the part of "Analysis problem", the content of this part is the analysis of the environment problem of China-ASEAN Free Trade area, starting with the performance of the environmental problem, the paper expounds the reason of the environmental problem in the Free Trade area. The third, fourth and fifth chapters are the problem solving part. The third chapter is the legal basis for solving environmental friction. The legal basis includes the environmental law of member countries, multilateral environmental agreements and trade and environmental measures. The conclusion is that domestic environmental law and trade-related environmental measures are not enough to solve the environmental problems faced by the Free Trade area, and China-ASEAN Free Trade area needs a special environmental law. The fourth chapter analyzes the North American Free Trade area (NAFTA) and the European Union (EU)'s environmental policy system, taking the NAFTA and EU's environmental policy as the objects, and analyzes the environmental policy system of NAFTA and EU FTAs. Characteristics and in the field of institutional, environmental cooperation to draw inspiration. The fifth chapter constructs the China-ASEAN free trade area environment law, is the final foothold of this article, emphasizes the importance of environmental cooperation, from the construction of the basic theory, construction principles, models, environmental cooperation four aspects of their own ideas and suggestions. The main argument of this paper is that it is not enough to correctly deal with the environmental problems in the free trade area by relying solely on the domestic laws of member States and multilateral environmental agreements, and that cooperation in the field of environment needs to be strengthened. This paper establishes an environmental law of China-ASEAN Free Trade area, and puts forward some opinions and suggestions on how to construct this environmental law.
