山东沿海防护林法律保护问题研究

【摘要】：海岸线为沿海地区的经济发展带来契机,同时也给沿海地区带来台风、海啸、风沙等自然灾害。沿海防护林作为沿海地区的“绿色屏障”,其建设对改善沿海地区生态环境,维护沿海地区的生态安全,人民生命、财产安全和工农业生产安全具有重大意义。山东省沿海防护林体系建设工程是我国沿海防护林体系建设工程的重要组成部分,其建设对于沿海地区有着重要的生态、经济和社会意义。近年来,山东省沿海防护林的建设取得了显著的成效,沿海地区的生态安全和人民的生命财产安全有了一定的保障。但是,防护林建设过程中,仍然存诸多问题：体系结构不完善,滨海湿地削减,防护效能低下等等。人为因素是山东沿海防护林的大部分问题之所在,在法治社会的现在,完备的法制对山东沿海防护林的建设与保护具有重大的意义。本文通过对国内现有的有关沿海防护林的法律制度的分析,以及对美国和日本沿海防护林相关制度的考察,对山东省沿海防护林体系建设与法律保护的不足之处予以探讨。现代沿海防护林健康发展要求完备的法律制度和高效的行政执法,加上再近年来公民的法律意识的不断增强,行政执法完善与执法监督的加强越来越具有重要性。建构全省范围的统一法律制度,构建沿海防护林集中性执法,完善社会团体和公民对沿海防护林的监督机制,将防护林建设与市场经济相结合,本文从上述几个方面对山东省沿海防护林的管护提出了完善建议。
[Abstract]:Coastline brings opportunities for economic development of coastal areas, but also brings natural disasters such as typhoons, tsunamis, sand and other natural disasters to coastal areas. As the "green barrier" of coastal areas, the construction of coastal shelterbelt is of great significance to improve the ecological environment of coastal areas, maintain the ecological security of coastal areas, people's lives, property safety and industrial and agricultural production safety. The coastal protection forest system construction project of Shandong Province is an important part of the coastal protection forest system construction project of our country, and its construction has important ecological, economic and social significance to the coastal area. In recent years, the construction of coastal shelterbelt in Shandong Province has achieved remarkable results, and the ecological security of coastal areas and the safety of people's lives and property have been guaranteed to a certain extent. However, there are still many problems in the process of shelterbelt construction, such as imperfect system structure, reduced coastal wetland, low protection efficiency and so on. Human factors are the main problems of Shandong coastal protection forest. In the society of rule of law, the perfect legal system is of great significance to the construction and protection of Shandong coastal protection forest. Based on the analysis of the existing legal system of coastal shelterbelts in China and the investigation of the relevant systems of coastal shelterbelts in the United States and Japan, this paper probes into the inadequacies of the construction and legal protection of coastal shelterbelt systems in Shandong Province. The healthy development of modern coastal shelterbelts requires a complete legal system and efficient administrative law enforcement. In addition, in recent years, the citizens' legal consciousness has been continuously strengthened, so the perfection of administrative law enforcement and the strengthening of law enforcement supervision are becoming more and more important. To construct the unified legal system of the whole province, to construct the centralized law enforcement of the coastal shelterbelt, to perfect the supervision mechanism of the social organizations and citizens to the coastal shelterbelt, and to combine the construction of the shelterbelt with the market economy, This paper puts forward some suggestions on the management and protection of coastal shelterbelt in Shandong Province from the above several aspects.
