我国电子垃圾回收处理法律制度研究

【摘要】： 电子产品的普及在给人们的工作生活带来便利的同时,也带来了大量的电子垃圾。电子垃圾具有污染性和资源性双重特点。从环境污染角度来看,电子垃圾含有的有毒有害物质呆滞性长,扩散性小,对周围生态环境和人体健康造成的危害比普通生活垃圾更大。从资源回收利用角度看,电子垃圾里面含有很多贵重金属,如果直接弃之则会造成具大的资源浪费。因此对电子垃圾的回收处理问题进行研究,既可以保护环境,又可以节约资源。不仅符合我国发展循环经济的战略,也符合现阶段我国建设节约型社会的目标和全球可持续发展战略。虽然我国已有电子垃圾的相关立法,但许多重要的制度仍有待于建立。因此,对我国电子垃圾回收处理的法律制度进行研究是非常必要的。文章主要按照提出问题、分析问题、解决问题的思路进行研究,初步探讨了我国的电子垃圾回收处理法律制度的完善思路。文章首先对电子垃圾的概念进行了法理分析,清楚界定其基本含义及特征。并对我国电子垃圾回收处置现状分及原因进行分析。其次对外国发达国家或地区电子垃圾的相关立法进行概述,并重点论述了“延伸生产者责任”制度,并从中借鉴了对完善我国立法有利的依据；最后针对我国当前电子垃圾回收处理的立法现状,对电子垃圾回收处理法律制度提出“两点一线—配合”的完善思路。其中“两点”是指无价值电子垃圾最终的安全处理和有部分价值电子垃圾的回收问题；“一线”是指贯穿于电子垃圾回收处理管理中的相关主体的认识问题；“一配合”是指电子垃圾周期链条中相关主体的责任配置问题。
[Abstract]:The popularization of electronic products brings convenience to people ' s work life , and also brings great amount of electronic waste . The electronic waste has the dual characteristics of pollution and resource . From the viewpoint of environmental pollution , the electronic waste contains many precious metals , and it can save resources . It can not only protect the environment , but also save the resources .

This paper mainly discusses the idea of the legal system of electronic garbage collection and treatment in China according to the problems , the analysis and the solution to the problem .

Firstly , the concept of e - waste is analyzed and its basic meaning and characteristics are clearly defined . The present situation and reasons of e - garbage collection and disposal in China are analyzed . Secondly , the relevant legislation of e - waste in foreign countries or regions is summarized , and the system of " extended producer responsibility " is discussed .
At last , aiming at the current legislation status of electronic waste recycling treatment in China , the paper puts forward a perfect idea of " two - point line - cooperation " for the legal system of electronic garbage collection and treatment . The two points refer to the safety treatment of the non - value electronic garbage and the recycling of some valuable electronic waste ;
" first - line " refers to the problem of cognition that runs through relevant subjects in the management of electronic garbage collection and treatment ;
" One Mate " refers to the question of the responsibility arrangement of the relevant subjects in the electronic waste cycle chain .
