气候变化背景下的中国环境影响评价制度发展研究

【摘要】:文章阐述了环境影响评价(EIA)控制气候变化问题方面的优势,论述了EIA是控制气候变化的一个很有潜力的途径。文章首先对中国控制气候变化的法规、政策、措施等做了描述,阐述了目前规制碳排放的法规存在的问题。然后论述了中国EIA的立法及实施现状,并就气候变化纳入EIA规制范围这一问题的国际实践,对加拿大和美国的相关立法及实践案例做了简单的介绍。重点放在EIA在控制温室气体排放的可行性及功能优势的分析上,内容主要包括EIA是一个将全球性的气候变化问题与地方法规、决策相结合的桥梁;可以为避免重大环境影响提供可行的替代方案;可以利用现有法律框架解决气候变化问题;是一种灵活的辅助决策工具;能考虑温室气体排放的累积影响,符合共同但有区别责任原则等。气候变化问题纳入EIA的考虑范围为中国积极参与全球应对气候变化行动,完成哥本哈根气候变化峰会所承诺的碳密度减排目标提供了一条新的前瞻性的途径,文章对二者的结合做了必要性分析。最后,文章简单讨论了EIA应对气候变化所面临的困难与挑战。
[Abstract]:This paper expounds the advantages of environmental impact assessment (EIA) in controlling climate change, and discusses that EIA is a potential way to control climate change. This paper first describes the laws, policies and measures of controlling climate change in China, and expounds the problems existing in the current regulation of carbon emissions. Then it discusses the current situation of legislation and implementation of EIA in China, and introduces the international practice of bringing climate change into the scope of EIA regulation, and gives a brief introduction to the relevant legislation and practice cases of Canada and the United States. Emphasis is placed on the analysis of the feasibility and functional advantages of EIA in controlling greenhouse gas emissions, including that EIA is a bridge that combines global climate change issues with local laws and decisions; Could provide viable alternatives to avoiding significant environmental impacts; address climate change using existing legal frameworks; be a flexible tool for supporting decision-making; and take into account cumulative impacts of greenhouse gas emissions, In line with the principle of common but differentiated responsibilities, etc. The inclusion of climate change issues in the EIA provides a new and forward-looking way for China to participate actively in the global response to climate change and to meet the carbon intensity reduction targets promised at the Copenhagen Climate change Summit. This paper analyzes the necessity of the combination of the two. Finally, the paper briefly discusses the difficulties and challenges faced by EIA in dealing with climate change.
