权力冲突视角下环境权的理性思辨——基于公民环境权保护的需要

【摘要】：环境危机覆巢之下,安有完卵。人们关注日益恶化的生态环境,关注人类滋生的环境权益。以环境正义为视角,环境危机具有特殊运行轨迹,较之于发达国家发展中国家为危机的重灾区,较之于城市环境综合治理累累成果城乡结合部及广大农村地区为危机重灾区,较之于富有社会阶层贫困人口为重灾阶层。于是,相对于强势企业,弱势公民的环境权保护纳入理论视野。然而,从公民环境权保护的问题意识出发,环境权保护面临着冲动的情感视角与难解的权利冲突的困境。要做到将环境权变为法定的、切实受到保护的尸体权利,需破解环境权与发展权、环境权与资源权的权力冲突,对环境权进行理性定位。
[Abstract]:Under the nest of the environmental crisis, there is a complete egg. People pay attention to the deteriorating ecological environment and the environmental rights and interests of mankind. From the point of view of environmental justice, the environmental crisis has a special running track. Compared with the developed countries, the developed countries are the worst hit areas, compared with the urban and rural areas, the urban and rural areas are the worst hit areas. Compared with the rich social class, the poor are the most serious class. Therefore, relative to the strong enterprises, the protection of the environmental rights of the weak citizens into the theoretical field of vision. However, based on the problem consciousness of citizen's environmental right protection, environmental right protection is confronted with the dilemma of impulsive emotional perspective and difficult right conflict. In order to change environmental rights into legal and protected corpse rights, it is necessary to solve the conflicts between environmental rights and development rights, environmental rights and resource rights, and to rationally position environmental rights.
