电子废弃物回收利用之立法研究

【摘要】： 本文以对电子废弃物回收利用相关概念考查为出发点,比较国外先进的回收利用立法实例,参照本国现实状况以及回收过程中所遇到的困境,提出电子废弃物回收利用立法的指导思想与核心内容。通过对最新颁布的《废弃电器电子产品回收处理管理条例》的分析,从我国相关立法的沿革探讨对于电子废弃物回收立法的特点与不足,并且提出自己的建议。首先,笔者归纳出,电子废弃物回收利用立法应该以循环经济理念为指导思想,以实施生产者延伸责任为立法的核心内容,在政府、生产者和消费者之间划分各自的责任承担范围,共同构建一套完整的回收处理体系。其次,通过对国内相关立法的回顾,归纳出我国已初步建立起一个以《循环经济促进法》为原则性立法,以《固体废物污染环境防治法》为综合法律,以《废弃电气电子产品回收处理管理条例》和《电子信息产品生产污染防治管理办法》为下位专项法规的电子废弃物回收利用法律法规体系。再次,通过对《废弃电气电子产品回收处理管理条例》的分析,归纳出目前我国电子废弃物回收利用立法的不足之处,试图通过借鉴国外先进的立法经验,对此予以完善。要确立科学的可持续发展的思想,确立资源—产品—再生资源的经济发展模式,科学地认识“废弃物”,使经济增长、社会发展与保护环境相协调；确立政府引导、扶持和市场推进相结合的思想,循序渐进,因地制宜。在生产环节,要求节能降耗,清洁生产,全程控制防治污染,实行生产者责任延伸,合理延长产业链,强化对各种生产“废料”的循环利用。在消费环节,提倡环境友好节约型的消费方式,要求尽可能地增加产品使用方法和次数,延长产品和服务的时间,对仍具有使用价值但被废弃的物品进行修理续用而不是频繁更换,更不能随意丢弃。在实践立法中,要求完善再生资源回收体系,通过对废弃物的回收利用,实现“废弃物”多极资源化和资源闭合式良性循环。
[Abstract]:Based on the examination of the related concepts of recycling and utilization of electronic wastes, this paper compares the advanced legislation examples of recycling and utilization in foreign countries, referring to the actual situation in our country and the difficulties encountered in the process of recycling. The guiding ideology and core content of the legislation on recycling and utilization of electronic wastes are put forward. Based on the analysis of the newly promulgated regulations on Recycling and disposal of waste Electrical and Electronic products, this paper discusses the characteristics and shortcomings of the legislation on the recycling of electronic wastes from the history of relevant legislation in China, and puts forward its own suggestions. First of all, the author concludes that the legislation of recycling and utilization of electronic wastes should be guided by the concept of circular economy, and the core content of the legislation should be the implementation of extended producer responsibility in the government. Producers and consumers are divided into their respective responsibilities to build a complete recovery and treatment system. Secondly, by reviewing the relevant domestic legislation, it is concluded that China has preliminarily established a "Circular economy Promotion Law" as the principle legislation, and a "solid waste pollution Environment Prevention and Control Law" as a comprehensive law. The system of laws and regulations on the recycling and utilization of electronic wastes is based on the regulations on waste Electrical and Electronic products Recycling and disposal and the measures for the Prevention and Control of pollution in the production of Electronic Information products. Thirdly, through the analysis of the Regulation of waste Electrical and Electronic products Recycling and disposal, the paper summarizes the shortcomings of the legislation of recycling and utilization of electronic waste in our country, and tries to perfect it by drawing lessons from the advanced legislative experience of foreign countries. It is necessary to establish the scientific idea of sustainable development, establish the economic development model of resources-product-renewable resources, scientifically recognize "waste", coordinate economic growth, social development and environmental protection, and establish government guidance. The idea of combining support and market advancement, step by step, according to local conditions. In the process of production, it is necessary to save energy and reduce consumption, to clean production, to control pollution in the whole process, to extend producer responsibility, to extend the industrial chain reasonably, and to strengthen the recycling of all kinds of production "wastes". In the consumption link, it is necessary to promote environmentally friendly and economical consumption patterns, to increase as much as possible the method and frequency of product use, and to extend the time of products and services. Repair and reuse of items that are still useful but discarded, rather than frequent replacement, are not allowed to be discarded at will. In practical legislation, it is necessary to perfect the recycling system of regenerated resources, and to realize the "waste" multipolar recycling and closed virtuous circle of resources through the recycling and utilization of waste.
