我国能源法律体系研究

【摘要】：能源是人类社会进步和国民经济发展的重要物质基础，作为能为人类社会提供各种形式能量的一种资源，能源在人类社会生活中占有极其重要的地位，是人类生活必不可少的物质。21世纪的今天，世界经济的快速发展进入到一个新高潮，能源问题为全世界、全人类所普遍关注。能源的安全、经济、清洁、可持续供应对推进社会经济的可持续发展与和谐社会的建设至关重要。我国经济的高速发展基本依赖于能源的大量消耗，经济发展的同时也带来诸多的能源问题。例如，我国能源结构的不合理、能源效率低下、能源的供给和使用安全、能源的发展与环境保护的长期矛盾等。近年来，我国国民经济发展速度的更是不断攀升、工业化进程也不断加快，，我国已然成为世界能源生产和能源消费大国，发展所带来的能源问题已成为制约我国经济发展的主要因素之一。为解决能源给经济发展带来的瓶颈问题，世界各国都在寻求能源、环境、经济可持续发展之路。自1973年第三次石油危机，能源危机爆发后，许多西方发达国家基于对能源紧缺问题的认知和开发新能源技术的需要，纷纷加快了本国能源立法的相关工作；抓紧制定能源领域的能源法、能源单行法规，对本国能源法律进行汇编等，能源立法如火如荼的展开。世界能源立法的新高峰也于二十一世纪产生。通过不断完善能源立法，目前各发达国家已经建立起一套比较完备的能源法律体系，能源法发展得越来越细，越来越完备。我国能源立法经过数十年的努力，已经初具规模，能源法律体系的雏型已经初步构建起来。本文拟从法理学的角度对能源法律体系的内涵进行诠释，所谈及的能源法律体系不仅仅指能源立法体系，而是把与能源相关的一切法律规范，根据其不同的组合，全面、系统地归入能源法律体系中。本文通过分析我国能源法律体系的现状及存在的问题，借鉴主要发达国家在能源立法及构建能源法律体系方面的先进经验，主要是美国、日本、德国和澳大利亚等国家；分析比较国内外的能源立法基础和能源法律体系的建构模式，再结合我国国内的能源立法实践，通过建立金字塔型的能源法律结构体系，不断完善能源法律规范体系和建立完善的能源法律制度体系对我国能源法律体系的完善提出思考和建议，以期为我国能源立法系统化研究和中国特色能源法律体系的建设尽绵薄之力。
[Abstract]:Energy is an important material foundation for the progress of human society and the development of national economy. As a kind of resource which can provide various forms of energy for human society, energy plays an extremely important role in human social life. Today, the world economy has entered a new climax with the rapid development of the world economy. The energy problem is concerned by the whole world and all mankind. Energy security, economy, cleanliness and sustainable supply are very important to promote the sustainable development of social economy and the construction of harmonious society. The rapid development of China's economy basically depends on a large amount of energy consumption. Economic development also brings a lot of energy problems at the same time. For example, the energy structure of our country is unreasonable, the energy efficiency is low, the supply and use of energy is safe, the long-term contradiction between energy development and environmental protection and so on. In recent years, the speed of our national economy has been rising, and the process of industrialization has been speeding up. China has become a major energy producer and energy consumer in the world. The energy problem brought by the development has become one of the main factors restricting the economic development of our country. In order to solve the bottleneck problem that energy brings to economic development, countries all over the world are seeking the way of sustainable development of energy, environment and economy. Since the third oil crisis and energy crisis broke out in 1973, many western developed countries have speeded up the work of domestic energy legislation based on the cognition of energy shortage and the need of developing new energy technology. Energy legislation is in full swing. The new peak of world energy legislation also emerged in the 21 th century. Through the continuous improvement of energy legislation, each developed country has established a relatively complete energy law system, energy law has been more and more detailed, more and more complete. After decades of efforts, China's energy legislation has begun to take shape, the prototype of the energy legal system has been initially constructed. This paper intends to interpret the connotation of the energy legal system from the perspective of jurisprudence. The energy legal system in question not only refers to the energy legislative system, but also makes all the legal norms related to energy comprehensive according to their different combinations. Systematically incorporated into the energy legal system. By analyzing the current situation and existing problems of China's energy legal system, this paper draws lessons from the advanced experiences of major developed countries in energy legislation and the construction of energy legal system, mainly in the United States, Japan, Germany and Australia. This paper analyzes and compares the domestic and foreign energy legislative basis and the construction mode of energy legal system, and combines the domestic energy legislation practice of our country, through the establishment of pyramid energy legal structure system, To improve the legal system of energy and to establish a perfect legal system of energy, the author puts forward some thoughts and suggestions for the perfection of the legal system of energy in China. The aim is to contribute to the systematization study of energy legislation and the construction of legal system of energy with Chinese characteristics.
