论山东省矿产资源生态补偿的法律规制

【摘要】:山东省是我国的经济大省,同时也是资源消耗大省。随着社会经济的迅速发展和工业化进程的加快,矿产资源开发过程中的资源浪费和矿区生态环境恶化问题也日益严重,使山东省社会、经济、环境的协调发展面临巨大的挑战。矿产资源生态补偿机制是市场经济条件下环境资源管理的制度创新,它通过调整矿产资源开发利用相关利益各方经济利益和生态利益的分配关系,促进社会公平和环境正义,是新时期落实科学发展观、建设生态文明、构建和谐社会的重要举措。 长期以来,山东省在矿产资源开发领域过分倚重政策调整而忽视了市场经济条件下的法律机制调整,对矿产资源的破坏浪费和矿区生态环境治理修复缺乏强有力的法律手段,使得矿产资源生态补偿的长效机制一直未能真正建立。因此,完善山东省矿产资源生态补偿立法,建立健全山东省矿产资源生态补偿法律保障体系迫在眉睫。针对目前山东省的矿产资源生态补偿机制尚缺乏明确的制度指引和法律支撑的现状,论文对适合山东省的矿产资源生态补偿法制化路径和具体进程进行了初步设计,并着重从以下五个部分进行论述: 第一部分是引言。阐述了本文的选题意义、研究背景和国内外研究现状,简单介绍了本文的创新点和采用的论述方法。 第二部分从“发生的进路”去探求山东省矿产资源生态补偿的法制化需求,指出全国性的矿产资源生态补偿立法尚不健全以及与矿产资源生态补偿相关的地方性立法层出不穷是山东省矿产资源生态补偿的法制化需求的外因驱动因素;而山东省矿产资源生态补偿难以形成长效机制的重要原因是法律法规保障体系不足的事实,是内部支撑因素。在此基础上,论文指出山东省矿产资源生态补偿法制化的路径选择是制定《山东省生态补偿条例》,将山东省矿产资源生态补偿作为其中的一章专门规定,并通过相应的配套性法律和制度来补充和完善。 第三部分探讨了山东省矿产资源生态补偿立法过程中对矿产资源生态补偿的基本范畴做出明确界定的必要性,在明确生态补偿及其法律含义的基础上,论文对矿产资源生态补偿的目的与实质、矿产资源生态补偿的法律涵义及特征、矿产资源生态补偿法律关系的要素做了系统的论证分析。 第四部分指出山东省矿产资源生态补偿的法制化是一个系统工程,不仅仅是“法律化”的问题,在进行专门综合立法的同时,也要考虑相应的配套性法律和制度来补充和完善。在制度设计上,首先从矿业权有偿取得和使用制度、矿产资源生态补偿费制度、废弃矿修复治理基金制度、矿山环境治理与生态修复保证金制度四个方面进行基础性制度安排;其次要改革矿产资源生态补偿监管体制、健全矿产资源生态补偿标准评估制度、完善矿产资源规划制度、拓展省外矿业权合作制度、创新跨区矿产资源生态补偿责任承担机制以提供配套性制度支持。此外,论文还从充分发挥国家生态补偿条例立法的指导作用、搞好与环境损害赔偿立法的互补效益、促进环境保护立法和资源利用立法的统一等方面对山东省矿产资源生态补偿立法与国家法律的衔接问题做了详细的论述。 第五部分是结论,重申了人类进行生态环境资源保护的必要性,再次阐述山东省矿产资源生态补偿机制法制化的缘由、路径选择和具体进路,并期待论文所做的实证研究能对山东省适时建立一套可操作的矿产资源生态补偿法律法规和制度体系有所裨益。
[Abstract]:With the rapid development of the social economy and the accelerated process of industrialization, the waste of resources and the deterioration of the ecological environment in the mining area are becoming more and more serious with the rapid development of the social economy and the acceleration of the process of industrialization. The coordinated development of the society, economy and environment in Shandong province is facing great challenges. The Shandong province is confronted with a huge challenge. The ecological compensation mechanism is the institutional innovation of environmental resources management under the market economy. It is an important measure to implement the Scientific Outlook on Development, build ecological civilization and build a harmonious society in the new period by adjusting the mineral resources to exploit and utilize the relationship between the economic interests and ecological interests of the interested parties and promote social equity and environmental justice.
For a long time, Shandong province has overemphasized the policy adjustment in the field of mineral resources development and ignored the adjustment of the legal mechanism under the market economy, and the lack of strong legal means for the destruction and waste of mineral resources and the restoration and restoration of the ecological environment in the mining area. Therefore, the long-term mechanism of the mineral resources ecological compensation has not been truly established. It is imminent to improve the legislation of ecological compensation for mineral resources in Shandong province and establish a sound legal guarantee system for the ecological compensation of mineral resources in Shandong province. In view of the lack of clear institutional guidance and legal support for the ecological compensation mechanism of mineral resources in Shandong Province, the thesis is suitable for the legalization of the ecological compensation of mineral resources in Shandong province. And the specific process has been preliminarily designed, focusing on the following five parts:
The first part is the introduction. It expounds the significance of the topic, the research background and the research status at home and abroad, and briefly introduces the innovation and the discussion methods adopted in this paper.
The second part explores the legal demand for the ecological compensation of mineral resources in Shandong province from the "happening route". It points out that the legislation of the national mineral resources ecological compensation is not perfect and the local legislation related to the ecological compensation of mineral resources is the external cause of the legal demand of the mineral resources compensation in Shandong province. The important reason that the ecological compensation of mineral resources in Shandong is difficult to form a long-term mechanism is the fact that the legal and regulation system is insufficient and the internal support factor. On this basis, the paper points out that the path choice of the legalization of the ecological compensation of mineral resources in Shandong province is to formulate the ecological compensation regulations of Shandong Province, and the mineral resources ecology of Shandong province. As one of the provisions of compensation, compensation is supplemented and perfected through corresponding supporting laws and systems.
The third part discusses the necessity of defining the basic category of the mineral resources ecological compensation in the legislative process of ecological compensation for mineral resources in Shandong province. On the basis of the definition of ecological compensation and its legal meaning, the purpose and essence of the ecological compensation of mineral resources, the legal meaning and characteristics of the ecological compensation of mineral resources are discussed. The elements of the legal relationship of production resources ecological compensation are systematically analyzed and analyzed.
The fourth part points out that the legalization of the ecological compensation of mineral resources in Shandong is a systematic project, not only the question of "legalization", but also to supplement and improve the relevant relevant laws and systems, while the special comprehensive legislation is carried out. The source ecological compensation fee system, the abandoned mine remediation management fund system, the mine environmental governance and the ecological restoration margin system four basic institutional arrangements; secondly, the reform of the mineral resources ecological compensation supervision system, the improvement of the mineral resources ecological compensation standard evaluation system, the improvement of the mineral resources planning system, and expansion of the mining industry outside the province. In addition, the paper also gives full play to the guiding role of the legislation of the national ecological compensation regulations, and does a good job in the complementary benefits of the legislation of environmental damage compensation, and promotes the unification of environmental protection legislation and the utilization of resources legislation in Shandong. The connection between the legislation of mineral resources ecological compensation and the state laws is discussed in detail.
The fifth part is the conclusion, reaffirms the necessity of the protection of ecological environment resources for human beings, and expounds the reason for the legalization of the mechanism of ecological compensation of mineral resources in Shandong Province, the choice of path and the concrete approach, and expects that the empirical research done by the paper can set up a set of applicable laws and regulations on the ecological compensation of mineral resources in time for Shandong province. The system is of benefit.
