包装废弃物处理的法律问题研究

【摘要】：包装业的快速发展产生了过量的包装废弃物,我国城市垃圾中存在大量的包装废弃物其本身具有较高的回收价值,但由于缺乏成熟完善的回收体系,不仅浪费了包装资源,还给政府管理和生态环境带来了严峻压力。目前世界各国在管理包装废弃物时基本上都采取先“避免产生”、后“循环使用”、再“最终处理”的管理原则,以达到减少垃圾量、节约资源、资源、环境和经济协调持续发展的目标。由于我国科技水平的限制及限制商品过度包装的法律法规还不完善,对包装废弃物的管理产生了很大漏洞。提高技术水平、完善包装废弃物的法律制度建设,将对建设资源节约型、环境友好型社会起到关键性作用。 本文选题具有现实意义,在系统介绍包装废弃物概念、处理方式及产生危害的基础上,深入剖析包装废弃物中存在的问题,运用比较法对国外包装废弃物的立法及管理作了深入阐述,通过对国外包装废弃物处理的借鉴与比较,结合我国的现实情况,提出了一些合理性的建议。即通过增加企业责任,大力倡导绿色包装,加强政府监管,改变消费者理念及消费习惯,完善循环经济、过度包装等方面的法律法规,以期实现包装废弃资源的最大化利用及保护环境的目的。
[Abstract]:The rapid development of packaging industry has produced excessive packaging waste. There are a large number of packaging wastes in our country which have higher recycling value. However, due to the lack of mature and perfect recovery system, packaging resources are not only wasted. It also brings severe pressure to government management and ecological environment. At present, countries in the world basically adopt the management principle of "avoiding production", "recycling" and "final disposal" when managing packaging wastes, in order to reduce the amount of garbage and save resources. The goal of coordinated and sustained development of the environment and economy. Due to the limitation of scientific and technological level and the imperfect laws and regulations of limiting the excessive packaging of commodities, there are many loopholes in the management of packaging wastes. Improving the technical level and perfecting the legal system construction of packaging waste will play a key role in the construction of resource-saving and environment-friendly society. This thesis is of practical significance. On the basis of systematically introducing the concept, treatment and harm of packaging waste, the problems existing in packaging waste are deeply analyzed. The legislation and management of packaging waste in foreign countries are expounded by comparison method. Through the reference and comparison of packaging waste treatment abroad, some reasonable suggestions are put forward according to the reality of our country. That is, by increasing corporate responsibility, vigorously advocating green packaging, strengthening government supervision, changing consumer concepts and consumption habits, perfecting the circular economy, over-packaging and other aspects of laws and regulations, In order to maximize the use of packaging waste resources and protect the environment.
