试论船舶油污损害赔偿的法律适用

【摘要】:海洋是人类赖以生存和发展的重要源泉与空间,保护海洋环境是人类21世纪的重要议题之一。近年来,随着海上石油运输活动的日益增加,船舶油污损害赔偿的案件不断发生。但是目前我国调整船舶油污损害赔偿的法律、法规还不完善,不能较好的维护国家和当事人尤其是受害人的合法权益。因此,文章从我国当前司法实践出发,通过对我国加入的调整船舶油污损害赔偿的国际公约和我国法律、法规的比较分析,对不同类型的船舶碰撞或油污造成油污损害赔偿纠纷的法律适用进行总结,并就如何在损害赔偿责任主体、归责原则、赔偿范围、责任限制等法律适用问题上进行理论探讨,以便统一认识,提高裁判质量。因为法律适用是解决船舶油污损害赔偿纠纷的前提,所以研究船舶油污损害赔偿的法律适用具有重要的现实意义。 文章由五部分组成,首先是引言,主要阐述了文章研究的背景、目的和意义。第一章主要介绍船舶油污损害赔偿制度概述,着重对船舶油污损害的概念、特征和法律适用的概念和原则进行简要分析。第二章从法理学的角度阐述分析适用国际条约的理论依据和实践做法,并针对我国在船舶油污损害赔偿领域中适用国际条约的实践做法进行归纳和总结,进而提出应当如何协调适用国际公约和国内法的关系问题。第三章,主要对有关船舶油污损害赔偿的国际公约进行介绍,并就目前在我国如何适用公约提出自己的建议。并分析在不同情况下如何选择船舶油污损害赔偿的法律适用,以案件是否具有涉外因素进行分类分别选择适用:无涉外因素和涉外因素的案件。在解决了选择适用国际公约(涉外因素案件)或国内法(无涉外因素案件)的前提下,从船舶油污损害赔偿的责任主体、归责原则、赔偿范围、责任限制等角度进行分析和论述,并提出自己的建议。第四章阐述调整我国船舶油污损害赔偿国内法的规定和司法实践中存在的冲突,并着重指出国内法在调整船舶油污损害赔偿法律适用中存在的问题,依次从船舶油污损害纠纷适用法律过程中对责任主体、归责原则、赔偿范围、责任限制等问题进行分析和论述,并提出自己的建议。
[Abstract]:The ocean is an important source and space for human survival and development, and the protection of marine environment is one of the important topics in the 21st century. In recent years, with the increasing of oil transportation activities, the cases of compensation for oil pollution damage of ships occur constantly. But at present our country adjusts the ship oil pollution damage compensation law, the regulation is not perfect, cannot safeguard the country and the litigant, especially the victim's legal rights and interests. Therefore, starting from the current judicial practice of our country, the article compares and analyzes the international conventions and laws and regulations concerning the adjustment of compensation for oil pollution damage from ships entered into by our country. This paper summarizes the legal application of the dispute of compensation for oil pollution damage caused by different types of ship collision or oil pollution, and discusses how to apply the law to the subject of liability for damages, the principle of liability, the scope of compensation, the limitation of liability, and so on. In order to unify the understanding and improve the quality of the referee. Because the application of law is the premise to solve the dispute of compensation for oil pollution damage, it is of great practical significance to study the legal application of compensation for oil pollution damage. The article consists of five parts, first is the introduction, mainly expounds the background, purpose and significance of the article. The first chapter mainly introduces the system of compensation for oil pollution damage from ships, focusing on the concept, characteristics, concepts and principles of the application of the law to ship oil pollution damage. The second chapter analyzes the theoretical basis and practice of applying international treaties from the point of view of jurisprudence, and summarizes the practice of applying international treaties in the field of oil pollution damage compensation of ships in China. Then it puts forward how to coordinate the application of international conventions and domestic law. The third chapter mainly introduces the international convention on compensation for oil pollution damage from ships, and puts forward some suggestions on how to apply the convention in our country at present. It also analyzes how to choose the legal application of the compensation for oil pollution damage in different circumstances, and classifies the case into two categories: the case without foreign factors and the case with foreign factors. On the premise of choosing to apply international conventions (cases involving foreign factors) or domestic laws (cases without foreign factors), the liability subject, liability principle and compensation scope of compensation for oil pollution damage from ships are discussed. This paper analyzes and discusses the limitation of liability and puts forward its own suggestions. The fourth chapter expounds the conflict existing in the regulation and judicial practice of adjusting the domestic law of compensation for oil pollution damage from ships in China, and emphatically points out the problems existing in the application of the domestic law in adjusting the law of compensation for oil pollution damage from ships. This paper analyzes and discusses the subject of liability, the principle of liability, the scope of compensation, the limitation of liability and so on from the process of applying law in the dispute of oil pollution damage to ships, and puts forward its own suggestions.
