柳州市酸雨防治立法研究

【摘要】:广西壮族自治区柳州市在20世纪80年代末开始出现严重的酸雨污染,给工业、农业、居民生活和生态环境造成了巨大的损害。柳州市政府自1987年进行了一系列关于酸雨污染的科学研究,并在此基础上于1996年制定了《柳州市酸雨综合防治方案》。在方案的框架下,市政府制定了《柳州市大气污染物总量控制管理办法》、《关于加强用煤污染物排放监督管理的通告》、《柳州市机动车排气污染防治管理规定》、《柳州市大气污染物排污交易管理办法》等相关政府规章。这些规章对柳州市的酸雨治理起到了一定的积极作用,但内容不够全面,制定程序有缺陷,条文大量重复上位法而且过于原则化,已经落后于防治酸雨污染、促进经济发展的现实需要。本文创新性的提出了一些完善柳州市现有酸雨污染防治立法的建议,即对现行相关规章进行整合、修改,制定一部具有针对性、全面性、综合性的柳州市酸雨防治政府规章。本文首先分析了柳州市酸雨污染的现状及其成因、危害,其次对柳州市现行酸雨污染防治规章的内容进行评析,指出其中存在的缺陷和滞后性,论证进行综合性酸雨污染防治地方立法的必要性,借鉴中外酸雨污染治理的相关立法经验,阐述柳州市环境立法的学理依据和宪法、法律依据,确定立法目的及其原则,提出这部地方政府规章的主要内容,包括各部门分工与协作、能源管理、二氧化硫减排、酸雨信息发布和预警、环保出行、法律责任等六个方面。
[Abstract]:Serious acid rain pollution began to appear in Liuzhou, Guangxi Zhuang Autonomous region in the late 1980s, which caused great damage to industry, agriculture, people's life and ecological environment. The Liuzhou Municipal Government has carried out a series of scientific research on acid rain pollution since 1987, and on the basis of this, formulated the "Liuzhou Acid Rain Comprehensive Control Plan" in 1996. Under the framework of the plan, the municipal government has formulated the measures for the Control and Management of the Total amount of Atmospheric pollutants in Liuzhou City, the Circular on strengthening Supervision and Administration of pollutants discharged from Coal, and the regulations on the Prevention and Control of Motor vehicle exhaust pollution in Liuzhou City, Measures for the Management of Emission Trading of Air pollutants in Liuzhou City, and other relevant government regulations. These regulations have played a positive role in the treatment of acid rain in Liuzhou City, but they are not comprehensive enough, the formulation of procedures is flawed, the provisions repeat the epistatic law in a large number and are too principled, and they have fallen behind in the prevention and control of acid rain pollution. The realistic need of promoting economic development. This paper creatively puts forward some suggestions to improve the existing legislation of acid rain pollution prevention in Liuzhou, that is, to integrate and modify the existing relevant regulations, and to formulate a specific, comprehensive and comprehensive government regulation on acid rain control in Liuzhou. This paper first analyzes the present situation and causes of acid rain pollution in Liuzhou City, and then analyzes the contents of the current acid rain pollution prevention and control regulations in Liuzhou City, and points out the defects and lag of the existing regulations in the prevention and control of acid rain pollution in Liuzhou City. This paper demonstrates the necessity of comprehensive acid rain pollution prevention and control local legislation, draws lessons from the relevant legislative experience of domestic and foreign acid rain pollution control, expounds the theoretical basis and constitution, the legal basis of Liuzhou environmental legislation, and determines the legislative purpose and principles. The main contents of this local government regulation include the division of labor and cooperation among various departments, energy management, sulfur dioxide emission reduction, acid rain information release and early warning, environmental protection travel, legal liability, etc.
