新能源开发利用的行政法规制研究

【摘要】：中国经济的快速增长与高能耗高污染的矛盾日趋严重,开发利用新能源为从根本上解决这些问题提供了新的思路。要大力发展新能源,必须有坚实的规制手段和政策激励机制来推动,而一套良好的规制手段的实施需要理论上的深入研究。基于此,作者对我国新能源开发利用的行政法规制展开研究。根据我国新能源立法研究现状提出了本文的研究目的：明确新能源开发利用的行政法规制特征,深入探讨新能源行政立法和政策鼓励机制建立的必要性,完善新能源行政法规制制度体系。在明确新能源概念的基础上,通过新能源和可再生能源的概念和范围的比较,将新能源定义为以下几个方面：1、高效利用能源；2、资源综合利用；3、可再生能源；4、替代能源；5、核能；以及6、节能。阐述新能源开发利用的原因和发展趋势,得出在常规能源短缺和环境危机的背景下,开发利用新能源是必然的趋势,进而探讨我国在开发新能源方面存在的行政法律问题,由于我国新能源开发利用规模小,缺乏整体规划,导致能源浪费现象严重,加之我国新能言开发利用的行政立法和政策鼓励机制不完善,使我国新能源开发利用愈加艰难。本文通过分析论证,采用文献研究法、历史研究法和对比研究法,借鉴美日等发达国家在开发利用新能源方面的行政规制手段的经验,提出我国新能源开发利用中从行政立法的完善、配套激励政策的提出和行政合同与行政指导手段应用的建议。
[Abstract]:The contradiction between rapid economic growth and high energy consumption and high pollution in China is becoming more and more serious. The development and utilization of new energy sources provide a new way of thinking to solve these problems fundamentally. In order to develop new energy vigorously, we must have solid regulation means and policy incentive mechanism to promote, and the implementation of a set of good regulation means needs theoretical in-depth study. Based on this, the author studies the system of administrative regulations for the development and utilization of new energy in China. According to the current research situation of new energy legislation in China, the purpose of this paper is to make clear the characteristics of administrative laws and regulations for the development and utilization of new energy, and to probe into the necessity of establishing administrative legislation and policy encouragement mechanism of new energy. We will improve the system of new energy administrative laws and regulations. On the basis of clarifying the concept of new energy, through the comparison of the concept and scope of new energy and renewable energy, the new energy is defined as the following aspects: 1, efficient use of energy; 2, comprehensive utilization of resources; 3, renewable energy; 4, alternative energy; 5, nuclear energy; and 6, energy saving. This paper expounds the reasons and development trend of the development and utilization of new energy, and concludes that under the background of the shortage of conventional energy and the environmental crisis, the exploitation and utilization of new energy is an inevitable trend, and then discusses the administrative and legal problems existing in the development of new energy in China. Due to the small scale of new energy development and utilization in our country and the lack of overall planning, the phenomenon of energy waste is serious, and the administrative legislation and policy encouragement mechanism of new energy development and utilization in our country is not perfect, which makes the development and utilization of new energy in our country more difficult. Through analysis and argumentation, this paper uses the methods of literature research, history research and contrast research to draw lessons from the experiences of the developed countries, such as the United States and Japan, in the development and utilization of new energy resources. The paper puts forward some suggestions on how to perfect the administrative legislation, the supporting incentive policy and the application of administrative contract and administrative guidance in the development and utilization of new energy in China.
