矿业权生态化研究

【摘要】：矿业权是进行矿产资源开发利用的资格,但我国目前的矿产资源利用过程中存在着一些问题,法律生态化是当下我国法律发展的的趋势。进行研究矿业权生态化,通过分析矿业权的含义及生态化的含义,对矿业权生态化进行定义,同时对矿业权生态化的价值和功能进行阐述,论证矿业权生态化的必要性和可行性,提出矿业权生态化应当遵循的基本原则,对矿业权生态化实现的主要路径进行阐述。第一部分从矿业权和生态化的概念着笔,提出了矿业权生态化的基本概念,并对我国的矿业权生态化的表现进行说明,指出了矿业权生态化的意义所在;第二部分着重阐述了矿业权生态化的必要性和可行性,从价值论和问题论的角度论证矿业权生态化的必要性,在法律基础和政策基础的语境下分析矿业权生态化的可行性;第三部分,通过环保权利、环保义务、权利科学行使的分析,提出了矿业权生态化应当遵循的原则;第四部分,由于我国并未真正实现矿业权生态化,笔者在健全矿业权行政审批制度、生态补偿体制的建立、矿业权管理体制的改革三个方面提出了矿业权生态化的主要路径。本文是对矿业权在行使过程中如矿业权何实现对环境的保护,即生态化进行研究,研究的目的是规范矿业权人行使矿业权,让矿业权人重视矿业权行使过程的环境保护,同时提出了一些法律建议以期对我国的矿业权生态化进程产生影响,实现矿产资源的合理利用,矿产资源的科学利用和可持续发展,最终实现矿业权生态化——环境保护与矿产资源利用的平衡。
[Abstract]:Mining right is the qualification of mineral resources exploitation and utilization, but there are some problems in the process of mineral resources utilization in our country at present. Through analyzing the meaning of mining right and the meaning of ecologicalization, this paper defines the ecologicalization of mining right, and expounds the value and function of ecologicalization of mining right. This paper demonstrates the necessity and feasibility of ecologicalization of mining rights, puts forward the basic principles which should be followed in ecologicalization of mining rights, and expounds the main ways to realize ecologicalization of mining rights. In the first part, the author puts forward the basic concept of mining right ecology from the concept of mining right and ecology, and explains the performance of mining right ecology in our country, and points out the significance of mining right ecology. The second part focuses on the necessity and feasibility of ecologicalization of mining rights, demonstrates the necessity of ecologicalization of mining rights from the angle of value theory and problem theory, and analyzes the feasibility of ecologicalization of mining rights in the context of legal basis and policy basis. The third part, through the environmental protection right, the environmental protection duty, the right scientific exercise analysis, proposed the mining right ecology should follow the principle; The fourth part, because our country has not really realized the ecologicalization of mining rights, the author puts forward the main path of ecologicalization of mining rights in three aspects: perfecting the administrative examination and approval system of mining rights, establishing the ecological compensation system and reforming the management system of mining rights. In this paper, the author studies how to protect the environment in the process of mining right, that is to say, ecology. The purpose of the study is to standardize the mining right holders' exercise of mining rights, and let mining rights owners attach importance to the environmental protection in the process of mining rights exercise. At the same time, some legal suggestions are put forward in order to influence the ecological process of mining rights in China, to realize the rational utilization of mineral resources, the scientific utilization and sustainable development of mineral resources. Finally, the ecologicalization of mining rights is realized-the balance between environmental protection and mineral resources utilization.
