论我国环境监测制度的功能嬗变与立法完善

【摘要】：20多年来我国环境监测的基本功能已从末端监控发展为源头监控和全过程监控。这一功能嬗变导致其对环境行政主管部门在监督职能的专门化方面提出了更高的要求。为提高环境监测制度的适应性,建议修改《环境保护法》第11条,明确环保行政管理部门可将"监""测"职能分离,突出其环境监督职能的专门化特征。
[Abstract]:In the past 20 years, the basic function of environmental monitoring in China has developed from terminal monitoring to source monitoring and whole process monitoring. The evolution of this function leads to a higher demand for the specialization of the supervision function of the environmental administrative department. In order to improve the adaptability of the environmental monitoring system, it is suggested that Article 11 of the Environmental Protection Law be amended to make it clear that the administrative departments of environmental protection can separate the functions of "monitoring" and "measuring" and highlight the specialized features of their functions of environmental supervision.
