试论合同能源管理法律制度的完善

【摘要】：合同能源管理作为十大重点节能工程主推的节能新机制之一,有着兼顾社会、国家、企业客户、节能服务公司各方利益,实现双赢甚至多赢的运作模式。无论是哪一种商业化运作都不能完全的避免法律风险,商业化的节能模式也无法例外,除了要面对艰难的市场推广外,还要面临着旧观念抵制、体制缺陷、法律障碍和法律制度缺失、缺少权威的中介等问题,还要面对合同能源管理项目运作中各阶段可能产生的法律风险。 本文旨在以合同能源管理项目运作为主线,通过对项目运行各阶段的风险进行分析,试图给出风险控制与应对的方法,并结合合同能源管理的特点,探讨建立促进合同能源管理模式规范发展的法律法规与制度。
[Abstract]:Contract energy management, as one of the new energy conservation mechanisms promoted by ten key energy conservation projects, has a win-win or even win-win operation mode, which takes into account the interests of society, the country, enterprise customers and energy-saving service companies. No matter what kind of commercial operation can not completely avoid the legal risks, the commercial energy saving mode is no exception, in addition to facing the difficult market promotion, but also facing the resistance of old ideas, system defects, Legal obstacles and lack of legal system, lack of authoritative intermediary and other problems, but also facing the contract energy management project in the various stages of the possible legal risks. The purpose of this paper is to take the operation of the contract energy management project as the main line, through the analysis of the risks in each stage of the project operation, to try to give the methods of risk control and response, and to combine the characteristics of the contract energy management. This paper discusses the establishment of laws, regulations and systems to promote the development of contract energy management model.
