我国电子废弃物污染防治法律制度研究

【摘要】：随着经济和电子信息技术的迅猛发展，电子产品更新换代的速度越来越快。电子产品的广泛应用给人类带来了便利，但也给环境带来了沉重的负担，它已成为世界上增长速度最快的污染物之一。2003年起，我国进入了家用电器更新高峰期，每年产生数以亿计的废旧电器；同时，我国每年还要容纳全世界近70%的电子废弃物。电子废弃物成分复杂，若对其处置不当，不但会严重损害生态环境和人体健康，还将造成资源的极大浪费。 要想从根本上遏制日益严重的电子废弃物污染，并对其进行合理利用，立法是关键，而我国的相关立法并不完善。本论文旨在从法律角度为电子废弃物的污染防治提出合理建议。课题主要包括以下内容： 论文先界定了电子废弃物的概念并列举其特征，介绍了我国电子废弃物的处置状况和电子废弃物的具体危害。然后，第三章列举了包括《固体废物污染环境防治法》、《清洁生产促进法》在内的电子废弃物相关立法中的规定，并指出其不足之处。论文第四章，介绍了国际和国外的电子废弃物相关立法。国际公约方面，主要介绍《控制危险废物越境转移及其处置巴赛尔公约》（以下简称《巴赛尔公约》）；国外立法方面，主要介绍欧盟WEEE指令和日本、美国等国的相关法律制度，这些国家在电子废弃物立法方面走在世界前列。在该章的最后，总结他国立法及国际公约规定的可借鉴之处。在借鉴国外先进立法经验的基础上，结合实际国情，在第五章中为我国电子废弃物污染防治法律制度完善提出建议。论文的最后一部分是结语，总结论文主要内容和研究的不足之处，展望电子废弃物法律制度完善的发展趋势。
[Abstract]:With the rapid development of economy and electronic information technology, the renewal of electronic products is getting faster and faster. The wide application of electronic products has brought convenience to human beings, but also brought a heavy burden to the environment. It has become one of the fastest growing pollutants in the world. Since 2003, China has entered the peak period of household appliances renewal. The production of hundreds of millions of waste electrical appliances every year; At the same time, China has to accommodate nearly 70% of the world's electronic waste every year. The composition of electronic waste is complex, if it is not properly disposed of, it will not only seriously damage the ecological environment and human health, but also cause a great waste of resources. Legislation is the key to curb the increasingly serious pollution of electronic waste and make rational use of it. However, the relevant legislation in China is not perfect. The purpose of this paper is to put forward reasonable suggestions for the prevention and control of electronic waste pollution from the legal point of view. The thesis mainly includes the following contents: firstly, the paper defines the concept of electronic waste and enumerates its characteristics, introduces the disposal status of electronic waste in China and the specific harm of electronic waste. Then, the third chapter enumerates the regulations of E-waste legislation, including solid waste pollution Prevention and Control Law and Cleaner production Promotion Law, and points out the shortcomings of E-waste legislation, which includes solid waste pollution Prevention and Control Law and Cleaner production Promotion Law. The fourth chapter of the paper introduces the international and foreign electronic waste related legislation. In terms of international conventions, it mainly introduces the Basel Convention on the Control of Transboundary movements of Hazardous wastes and their disposal (hereinafter referred to as the Basel Convention); Foreign legislation, mainly introduces the EU WEEE Directive and the relevant legal systems of Japan, the United States and other countries, these countries in the electronic waste legislation in the forefront of the world. At the end of this chapter, the legislation of other countries and the provisions of international conventions can be used for reference. Based on the experience of foreign advanced legislation and the actual situation, the fifth chapter puts forward some suggestions for the improvement of the legal system of electronic waste pollution prevention and control in China. The last part of the paper is the conclusion, summarizes the main contents and shortcomings of the research, and looks forward to the development trend of the perfect legal system of e-waste.
