山西省自然保护区生态环境保护法律问题研究

【摘要】： 自然对于人类社会而言,其重要性和战略意义从来都是历久弥新。而建立自然保护区则是解决人类自身困境,保护生态物种多样性的重要措施。具体到中国乃至山西,环境问题的严峻程度其实已经到了无需赘言的地步,而对山西省的自然保护区管理进行法制化思考和设计更有其客观现实性和必要性。需要反思山西省自然保护区法律制度,以科学发展观的理论指导我们的自然保护区法治建设。 自1956年我国建立第一个自然保护区以来,自然保护区的数量已经达到两千多个,量不算少,但质亟待提高。自然保护区建设和管理过程中所暴露出的日益严重的问题,使我们不得不开始思考,我们的自然保护区制度究竟怎么了?是什么制约着自然保护区的发展?带着这些问题,笔者按照分析基本情况、发现问题,到寻找原因、解决问题的顺序,比对全国的情况,借鉴国外发达国家的经验,对山西省自然保护区的相关法律问题进行剖析,最后提出完善的建议。研究自然保护区的法律规制问题,对于自然保护区的保护与充分发挥其在生态环境中的作用意义重大。 本文运用了法学、生态学、经济学等理论,及引数据、列图表、作比较等方法,对山西省的自然保护区的具体情况做了细致分析,总结其特点,分析其不足,以此为基础,提出一些完善和解决的意见和建议。 本文共分五个部分,其构思与写作旨在重新梳理人与自然之间的关系,从自然保护区的法治现状入手,研究和分析山西省自然保护区法制建设中的诸多法律问题,同时对科学发展观与可持续发展理念在环保立法领域的进一步贯彻与落实提供理论支持。 第一部分是自然保护区生态环境保护法律制度的理论基础,从国际组织、其他国家和我国对自然保护区的不同定义等基本问题入手进行横向比较,从生态人类中心主义、可持续发展、以及人与自然和谐相处等三个角度对“环境与生态保护的理论与原则”进行知识梳理,为全文的系统论述奠定基础。 第二部分是我国自然保护区生态环境保护法律问题的现状分析,主要评介了我国自然保护区的建设与管理现状,采取从国家到地方的顺序对自然保护区的法律现状进行综述,分析我国自然保护区的法律调控中存在诸如立法思想、法律位阶等典型问题。 第三部分是山西省自然保护区生态环境保护现状的法学分析。通过数据分析和个案调查,总结归纳山西省自然保护区的成绩与问题、缺点与不足,并简要分析原因。 第四部分是域外自然保护区生态环境保护的法律实践对山西的启示。通过对美国,日本,加拿大等国家和地区自然保护区法律制度的介绍和分析,提炼其对山西自然保护区可资借鉴的经验。 第五部分是山西省自然保护区生态环境保护法律制度的完善。根据以上分析,提出完善山西省自然保护区法律制度的一些合理的设想。
[Abstract]:Naturally, for the human society, its importance and strategic significance have never been new. The establishment of the nature reserve is an important measure to solve the human's own plight and to protect the biodiversity of the ecological species. In particular, the severity of environmental problems in China and even in Shanxi has reached the point where it is not necessary to make a statement, and the legal thinking and design of the management of nature reserve in Shanxi have more objective reality and necessity. It is necessary to reflect on the legal system of the nature reserve of Shanxi Province, and to guide our natural reserve rule of law construction with the guidance of the scientific development view. Since the establishment of the first nature reserve in China in 1956, the number of nature reserves has reached more than two thousand. The growing problems that have been exposed in the construction and management of nature reserves have made us have to start thinking about the nature of our nature reserve system What's the matter? With these problems, the author, according to the basic situation of the analysis, finds the problem, finds the reason, the order of the problem and the situation of the developed countries, analyzes the relevant legal problems of the nature reserve in Shanxi, and finally puts forward the perfect. The suggestion of the study of the legal regulation of nature reserve, the protection and the full play of the role of the nature reserve in the ecological environment This paper makes a detailed analysis of the specific situation of the nature reserve in Shanxi province by using the theories of law, ecology, economics and so on.
