家庭暴力认定规则之探讨

【摘要】：家庭暴力是发生在家庭成员之间的暴力行为,是当前破坏婚姻家庭、侵害妇女、儿童和老人合法权益的亟待遏制的违法行为。这些践踏人权的行为不仅仅对人身造成极大的伤害和痛苦,而且还撕裂了整个社会结构。我国关于家庭暴力的现象正日益严重,其正发展为一个社会毒瘤严重的危害受害人的身心健康,侵害受害人的合法权益,破坏了社会稳定和发展。新婚姻法的施行,对防止家庭暴力,保护家庭成员的人身权利,保护妇女、老人、儿童的合法权益,促进社会安定有着十分重大的作用,但仍存在着许多问题,在很多方面还不完善。由于我国没有关于家庭暴力的专门立法,对家庭暴力的定义、家庭暴力的认定救助措施及法律责任都没有明确的规定。本文试就家庭暴力的认定方而提出拙见,以期人们能加深对家庭暴力的认识,从而有助于对家庭暴力的受害人提供更好的救助与保护。同时根据我国的国情,制订并出台我国的反家庭暴力法。
[Abstract]:Domestic violence is a violent behavior occurring among family members. It is an urgent act to destroy marriage and family, to infringe upon the legitimate rights and interests of women, children and the elderly. These trampling of human rights not only cause great harm and pain to human beings, but also tear up the whole social structure. The phenomenon of domestic violence is becoming more and more serious in China. It is developing into a social cancer, which seriously endangers the physical and mental health of the victims, infringes the legitimate rights and interests of the victims, and undermines social stability and development. The implementation of the new marriage law plays a very important role in preventing family violence, protecting the personal rights of family members, protecting the legitimate rights and interests of women, the elderly and children, and promoting social stability, but there are still many problems, which are not perfect in many aspects. Because there is no specific legislation on domestic violence in China, there is no clear definition of domestic violence, the identification of family violence, rescue measures and legal responsibilities. This article tries to identify family violence and the party put forward my opinion, hoping to help people to deepen the understanding of domestic violence, which is helpful for the victims of family violence to provide assistance and protection to better. At the same time, according to the national conditions of our country, we have formulated and promulgated the law against domestic violence in our country.
