我国法定夫妻财产制实务问题研究

【摘要】：家庭是社会的基本单位，承载着诸多的社会职能，世界上的每个人都与婚姻家庭有着密切的联系，因此，婚姻方面的立法涉及千家万户，与每个公民的切身利益息息相关。夫妻财产制是规定夫妻财产关系的法律制度，其调整的财产关系是一种建立在夫妻身份关系之上的财产关系，是婚姻法的重要组成部分。根据夫妻财产制发生的根据不同，可以分为法定夫妻财产制和约定夫妻财产制。根据我国《婚姻法》的相关规定，我国实行的是法定夫妻财产制和约定夫妻财产制相结合的法律制度。法定夫妻财产制相对于约定夫妻财产制而言，即指在夫妻婚前或婚后均未就夫妻财产关系作出约定，或所作约定无效的情况下，依法律规定而直接适用的夫妻财产制。随着婚姻法司法解释（一）（二）（三）的出台，我国夫妻财产制的规定正在逐步完善。但是随着社会的发展，我国经济、文化发生了极大的变化，现有的法定夫妻财产制在运用于法律实务中时，对于夫妻财产归属的认定也出现了争议。而夫妻财产归属的认定争议多发生在离婚案件的纠纷当中。本文第一部分概述法定夫妻财产制的相关理论，对我国法定夫夫妻财产制的立法现状以及进步性做了简要阐述；第二部分是结合法律在实际运用中的状况，提出我国法定夫妻财产制在实务中出现的主要问题；第三部分是介绍各国的相关立法经验，并对此进行评析，总结出对我国的借鉴意义。第四部分，，结合我国的实际国情民风，提出法定夫妻财产制在实务中出现的问题的解决之道，完善法定夫妻财产制对于夫妻财产归属认定的标准。
[Abstract]:Family is the basic unit of society, carrying many social functions, everyone in the world has close ties with marriage and family, therefore, marriage legislation involves thousands of families. It is closely related to the vital interests of every citizen. The property system of husband and wife is the legal system that prescribes the property relationship of husband and wife, and the property relationship adjusted by it is a kind of property relationship based on the relationship of marital status. Is an important part of the Marriage Law. According to the occurrence of marital property system based on different, can be divided into legal marital property system and contract marital property system. According to the relevant provisions of China's Marriage Law. Our country implements the legal husband and wife property system and the contract husband and wife property system unifies legal system. The legal husband and wife property system is relative to the agreement husband and wife property system. It refers to the husband and wife property system which is directly applicable according to the law when the couple has not made an agreement on the property relationship before or after marriage or if the agreement is invalid. With the introduction of the judicial interpretation of the Marriage Law, the provisions of the marital property system in China are being gradually perfected. However, with the development of society, great changes have taken place in the economy and culture of our country. The existing legal matrimonial property system is applied in the legal practice. For the identification of the property ownership of husband and wife has also appeared controversy. And the dispute of the ownership of husband and wife mostly occurs in the dispute of divorce cases. The first part of this article summarizes the related theory of legal property system of husband and wife. The legislative status and progress of the legal husband and wife property system in China are briefly expounded. The second part is to combine the law in the actual application of the situation, put forward the legal marital property system in the practice of the main problems; The third part is to introduce the relevant legislative experience of various countries, and to evaluate this, summed up the significance of reference to our country. 4th, combined with the actual situation of our national customs. This paper puts forward the solution to the problems in the practice of the legal marital property system, and consummates the standard of the legal matrimonial property system's ascertainment of the husband and wife's property.
