【摘要】：继承权丧失制度是我国继承制度的重要组成部分,此制度对维护继承人的合法权益,亲属之间的伦理道德,和睦的家庭关系和良好的社会秩序,构建和谐社会都具有重要作用。我国继承权丧失制度的立法以及相关的司法解释都制定于1985年,由于立法条件和立法技术的局限,我国继承权丧失制度的规定过于原则化和简单化,司法实践中操作性不强。例如,继承权丧失事由规定的不全面,相对丧失事由范围规定狭窄等等。在经济快速发展的20多年后,社会财富急剧增长,继承纠纷数量越来越多,情况也越来越复杂,现实中不断出现的新问题,使修改和完善我国继承权丧失制度成为亟待解决的重要课题。近年来学者较多地关注民法和婚姻法的修改和完善,对继承法尤其是继承权的丧失制度研究相对较少,关于继承权的丧失制度多见于各类继承法专著中。本文尝试对该制度进行系统论述,在借鉴国外和我国港、澳、台地区立法经验的基础上,结合实务操作,提出完善我国内地继承权丧失制度的立法建议。本文除引言和结语外,主要包括四部分: 第一部分问题的提出。通过三个典型案例,引出本文要研究的继承权丧失制度的相关问题。第二部分继承权丧失基本理论概述。这部分主要对继承权丧失制度的含义、分类、丧失事由、效力进行论述。第三部分外国立法例及我国港、澳、台地区立法例之考察。这部分主要对继承权丧失制度的外国立法例及我国港、澳、台地区立法例进行考察和评析。第四部分我国内地立法的现状和不足及完善立法的建议。本部分就是结合我国立法的现状和不足,并借鉴外国及我国港、澳、台地区的立法经验对我国立法进行修改和完善。
[Abstract]:The system of the loss of inheritance rights is an important part of the inheritance system in our country. It plays an important role in safeguarding the legitimate rights and interests of the heirs, ethics and morality among relatives, harmonious family relations and good social order, as well as the construction of a harmonious society. The legislation of the system of the loss of inheritance rights and the relevant judicial explanations were formulated in 1985. Due to the limitation of the legislative conditions and the legislative techniques, the provisions of the system of the loss of inheritance rights in our country are too principled and simplistic. In judicial practice, the operation is not strong. For example, the reason for the loss of inheritance is not comprehensive, the scope of relative loss is narrow, and so on. More than 20 years after the rapid economic development, social wealth has increased dramatically, and the number of inheritance disputes is increasing. The situation is becoming more and more complicated, and the new problems in reality make it an important task to modify and perfect the system of inheritance loss in our country. In recent years, scholars have paid more attention to the modification and perfection of civil law and marriage law. The system of the loss of inheritance rights is often found in all kinds of monographs of inheritance law. This paper attempts to systematically discuss the system, on the basis of drawing lessons from the legislative experience of foreign countries and China's Hong Kong, Macao and Taiwan regions, combining the practical operation, This paper puts forward legislative proposals to perfect the system of loss of inheritance rights in mainland China. In addition to the introduction and conclusion, this paper mainly includes four parts:. Through three typical cases, this paper introduces the relevant problems of inheritance loss system. This part mainly discusses the meaning, classification, reason and effect of inheritance loss system. The third part is the investigation of the foreign legislation and the legislation of Hong Kong, Macao and Taiwan. This part mainly reviews and comments on the foreign legislation of the system of the loss of inheritance rights and the legislation of Hong Kong, Macao and Taiwan in China. This part is to combine the present situation and deficiency of legislation of our country, and to learn from the legislative experience of foreign countries, Hong Kong, Macao, and Taiwan to revise and perfect our legislation.
