父母“管教权”掩盖下的家庭暴力——兼谈亲权制度完善

【摘要】：在我国亲权制度中包含了父母对子女的管教权,但现实生活中,存在着父母或其他监护人在“管教权”掩盖下,侵害子女人身权益,实施家庭暴力的现象。对此,文章解释了父母管教权的含义,分析产生家庭暴力的原因,介绍国外亲权立法经验,提出完善我国亲权制度的建议。
[Abstract]:The system of parental authority in our country includes the right of parents to discipline their children, but in real life, there is a phenomenon that parents or other guardians, under the cover of "right of discipline", infringe upon the rights and interests of children and carry out domestic violence. This paper explains the meaning of parental right of discipline, analyzes the causes of domestic violence, introduces the legislative experience of parental right in foreign countries, and puts forward some suggestions to perfect the system of parental right in our country.
