【摘要】：姓名权是人格利益重要的承载体,关系人的自由发展。未成年子女姓名权对处于成长期的子女具有深刻影响,保护好未成年子女姓名权对于子女身心健康的良好发展具有重要作用。我国现有的法律规范对子女姓名权的规定相对较少,社会对未成年子女姓名权的关注程度较低。然而随着离婚家庭数量的增多,父母离婚后未成年子女姓名权纠纷案例逐年增加,司法审判中存在着相同案件事实而裁判结果不同的情况。学者对于父母离婚后擅自变更子女姓名的问题也存在着不同的看法。2015年国家法官学院将父母离婚后擅自变更子女姓名纠纷案件作为唯一案例汇编于姓名权篇中,其意义的重要性可想而知。本文除引言、结论外,共分为五部分。第一部分,通过对比两起离婚后父母擅自变更子女姓名纠纷的典型案例,引出相同案件事实不同裁判结果的问题,得出父母能否单方面变更子女姓名和是否考虑子女意见两个焦点问题。第二部分,对父母离婚后未成年子女姓名权进行概述,总结分析了未成年子女姓名的权利基础和内容,论证得出父母离婚后仍然共同行使未成年子女姓名权。第三部分,通过举例分析国外关于姓名权的法律规范,吸收其精华部分,为我国完善姓名权法律规范提供借鉴。第四部分,在总结我国姓名权发展过程的基础上详细分析了我国关于姓名权的主要法律规范。第五部分,结合我国实际情况,提出完善我国父母离婚后未成年子女姓名权的建议。笔者认为行使未成年子女姓名权应坚持子女利益最大化和尊重子女意见原则,户籍机关应完善对子女姓名变更的管理,健全相应法律规范,明确父母离婚后仍共同决定未成年子女姓名,一方不得擅自变更子女姓名,但责令其恢复原姓氏时应合理考虑子女改姓后的使用及知晓程度。
[Abstract]:The right to name is an important carrier of the interests of personality, which is related to the free development of human beings. The right to name of minor children has a profound impact on the children in the growing period. It is very important to protect the right to name of minor children for the healthy development of their physical and mental health. However, with the increase of the number of divorced families, the dispute cases of minor children's right to name after divorce increased year by year. There are the same facts and different results in the judicial trial. Scholars also have different views on the problem of changing the children's names without authorization after the divorce of parents. 2015, the state academy of judges will divorce the parents without authorization. The case of a dispute over changing the name of a child is compiled as a sole case in the title of the right to name, In addition to the introduction and conclusion, this paper is divided into five parts. The first part, by comparing two typical cases of parents' unauthorized change of their children's names after divorce, The author draws the conclusion that whether parents can unilaterally change the name of their children and whether to consider the opinions of the children. The second part summarizes the right to name of minor children after the divorce of parents. This paper summarizes and analyzes the basis and content of the right to name of minor children, and proves that parents still jointly exercise the right of name of minor children after divorce. The third part, through the analysis of foreign legal norms on the right to name through examples, absorbs the essence of the right to name. Part 4th provides reference for our country to perfect the legal norm of the right of name. On the basis of summing up the development process of the right of name in our country, it analyzes in detail the main legal norm of the right of name in our country. 5th part, combined with the actual situation of our country, This paper puts forward some suggestions on how to improve the right to name of minor children after divorce. The author holds that the principle of maximizing the interests of children and respecting the opinions of children should be adhered to in the exercise of the right to name of minor children, and the household registration office should perfect the management of the change of children's names. Perfect the corresponding legal norm, make it clear that the parents still decide the minor child's name jointly after divorce, one party may not change the child's name without authorization, but order them to restore their original family name, should consider the use and the degree of knowledge after the children's changing surname reasonably.
