【摘要】：我国子女抚养费制度远远不能有力地保护未成年人身心的健康成长。本文先试图对子女抚养费的概念进行澄清,再简介我国现行子女抚养费制度,进而分析我国现行子女抚养费制度的缺陷与不足之处,最后对我国的子女抚养制度的完善提出建议与展望。本文基本内容如下：第一章是子女抚养费的概述。包括子女抚养费的概念,法律基础进行分析,特征,作用,新中国成立后的立法概况及其变迁。第二章介绍我国现行子女抚养费的一些具体制度。该章主要包括四节内容：子女抚养费权利义务主体,子女抚养费的数额确定模式,子女抚养费变更,子女抚养费的给付与强制执行制度。第三章分析我国现行子女抚养费制度的缺陷与不足。我国现行子女抚养费制度的缺陷及不足之处主要表现在七个方面。第四章是我国子女抚养费制度的完善建议。在第三章对我国子女抚养费制度存在的缺陷进行分析以后,笔者试图在本章对以上各缺陷提出完善建议。最后,对子女抚养费制度做出总结,并对我国立法提出展望。
[Abstract]:China's child support system is far from being able to protect the healthy growth of minors. This paper attempts to clarify the concept of child support, and then introduces the current child support system in China. Then it analyzes the defects and deficiencies of the current child support system in China, and finally puts forward some suggestions and prospects for the improvement of the child support system in China. The basic contents of this paper are as follows:. The first chapter is an overview of child support, including the concept of child support, legal basis for analysis, characteristics, role, after the founding of new China legislative overview and changes. The second chapter introduces some specific systems of child support in our country. This chapter mainly includes four sections: the subject of child maintenance rights and obligations, the model of determining the amount of child support, the change of child support. The system of payment and enforcement of child support. The third chapter analyzes the defects and deficiencies of the current child support system in our country. The defects and deficiencies of the current child support system in China are mainly reflected in seven aspects. Chapter 4th is the suggestion to perfect the system of child support in our country. After analyzing the defects of the system of child support in the third chapter, the author tries to put forward some suggestions for the improvement of the above defects in this chapter. Finally, the child maintenance system is summarized, and the prospect of our legislation is put forward.
