放弃继承利害关系人权益保护研究

【摘要】：随着社会经济的快速发展,公民个人财产关系的日益复杂,《继承法》在社会生活中的作用日益凸显。在司法实践中,因放弃继承而引发的案件纠纷也逐渐增多,但是由于《继承法》颁布较早,相关规定过于原则滞后,已不能很好的解决生活中出现的新问题新争议,导致了放弃继承人的债权人及配偶权益保护的缺失。同时《最高人民法院关于适用中华人民共和国婚姻法若干问题的解释(三)》的出台,虽然对配偶分割财产请求权做了规定,但依然没有明确继承人放弃继承时,配偶一方的相应救济权利。本文对该问题运用案例分析、对比等多种方法进行了分析,试图对完善《继承法》相关规定和债权人及配偶的权益保护提出有益的帮助。本文除去引言和结论,可分为四个部分。第一部分为放弃继承与利害关系人权益保护概述。主要介绍了放弃继承制度的内涵、性质和构成要件,并在此基础上了介绍了与放弃继承相关的利害关系人,明确下文将主要对债权人及放弃继承权人的配偶权益保护进行探讨。第二部分为放弃继承中影响利害关系人的具体问题分析。通过分析放弃继承制度中可能影响利害关系人的各种要件,并结合国外立法经验,指出了我国继承法的缺陷和不足以及可能导致的损害。第三部分为相关利害关系人的保护措施分析。结合放弃继承制度,分别对债权人和配偶的利益保护措施进行了分析阐述。通过不同案例的切入,引出学术界的争议和观点,论述了利害关系人的救济途径。第四部分为对利害关系人保护措施的建议。该部分主要从立法层面和具体措施方面进行阐述。结合前文的论述,提出完善《继承法》相关规定的具体建议,并阐明了债权人和配偶的权益保护措施。
[Abstract]:With the rapid development of social economy and the increasingly complex relationship between citizens' personal property, the "inheritance Law" plays an increasingly important role in social life. In judicial practice, the disputes caused by the abandonment of inheritance are also gradually increasing. However, due to the earlier promulgation of the inheritance Law and the lag of the relevant provisions in principle, it has not been able to solve the new problems and disputes that have arisen in life. At the same time, the interpretation of the Supreme people's Court on the application of the Marriage Law of the people's Republic of China (3) > was issued, although the right to claim for the division of property between spouses was stipulated. However, there is still no clear right of relief for one spouse when the heirs give up succession. This paper analyzes the problem by case study, comparison and other methods. This paper attempts to provide useful help to improve the relevant provisions of inheritance Law and the protection of the rights and interests of creditors and spouses. Apart from the introduction and conclusion, this paper can be divided into four parts. The first part is an overview of the waiver of succession and the protection of the rights and interests of interested parties. It mainly introduces the connotation, nature and constitutive requirements of the system of waiver of succession, and on this basis introduces the interested parties related to the waiver of succession. It is clear that the protection of the spouse's rights and interests of creditors and discards will be discussed below. The second part is the analysis of the specific problems that affect the interested parties in the waiver of succession. Through the analysis of the various elements which may affect the interested parties in the system of waiver of inheritance, and combined with the foreign legislative experience, The defects and deficiencies of inheritance law and the possible damages are pointed out. The third part is the analysis of the protective measures of the relevant interested parties. Combined with the system of waiver of inheritance, the author analyzes and expounds the measures of protecting the interests of creditors and spouses respectively. Through different cases, it leads to the controversy and viewpoint of the academic circles. This paper discusses the ways of relief for the interested parties. Part 4th is the suggestion for the protection measures of the interested parties. This part is mainly from the legislative level and the specific measures. Combined with the previous discussion, it puts forward specific suggestions to improve the relevant provisions of the inheritance Law. It also clarifies the protection measures of creditors and spouses.
