论《民法总则》对亲属身份行为的调整——兼评我国《民法总则》相关之规定

【摘要】：亲属身份行为是表意行为,潘德克吞范式民法总则未能实质性解决亲属身份行为得否适用法律行为的一般规则问题,学说上亦存在"适用说""不适用说"以及"区别适用说"等三种立场。亲属身份行为作为法律行为的下位概念,当家庭法对其无具体规定时自当适用法律行为制度的一般规则。但基于亲属身份共同生活关系的事实先在性、伦理性以及法效的既定性、安定性等品格,我国民法典总则上法律行为制度的设计应为亲属身份行为的调整预留适度空间。瑕疵亲属身份行为的效力认定规则应区别于财产行为,其被认定无效或撤销后的法律效果应不具有溯及力为宜。同时还应制定亲属身份行为瑕疵治愈规则,以尊重和保护身份关系的安定性以及家庭共同体成员的身份利益。
[Abstract]:The behavior of kinship identity is an ideographic act, and Pandecton Paradigm General principles of Civil Law fail to solve the question of whether the general rules of legal act can be applied to the act of kinship identity. In theory, there are three kinds of standpoints, such as "application theory" and "non-application theory" and "differential application theory". The act of relative identity is regarded as the lower concept of legal act. When the family law has no specific provisions on it, it should apply the general rules of the legal behavior system. However, the facts based on the kinship status living together are first, ethical, and the legal effect of the established, stability, and other characteristics, The design of the legal act system in the general principles of the Civil Code of our country should reserve moderate space for the adjustment of the act of relative identity, and the rules for determining the validity of the action of the defective relative should be distinguished from the act of property. The legal effect should not have retroactive effect after it is found invalid or revoked. At the same time, it should also formulate the rules of curing the imperfection of kinship identity behavior, in order to respect and protect the stability of the identity relationship and the identity interests of the members of the family community.
