受暴妇女消极维权的法理辨析——兼谈《反家庭暴力法》的修改

【摘要】：《反家庭暴力法》有诸多创新之处,为我国反家庭暴力实践提供了重要依据。但现行的法条中将受暴妇女设想为积极的行动者,认为她们会利用各种手段直至离婚改变受害状态。这一隐藏假设体现在反家暴法中过于将婚姻暴力的起诉权、监护人资格的撤销申请权和人身安全保护令申请权交给受害者。解构受暴妇女的积极行动假象后,发现受暴妇女受到多种结构性限制,很难离开施暴者。应当修订完善反家暴法,赋予家暴公益诉讼权,同时放宽监护人资格和人身安全保护令的申请资格,以真正维护受暴妇女的权益。
[Abstract]:The Law on domestic violence has many innovations and provides an important basis for the practice of combating domestic violence in our country. However, the current provisions of the law envisage women victims of violence as active actors. The hidden assumption that they will resort to all means until the divorce changes their victimization is reflected in the anti-domestic violence law, which overstates the right to sue for marital violence. The right of revocation of guardianship and the right to apply for a personal security protection order are handed over to the victim. After deconstructing the illusion of positive action by a woman subjected to violence, it is found that the woman who has been subjected to violence is subject to a variety of structural restrictions. It is very difficult to leave the perpetrators. The law against domestic violence should be revised and perfected, and the public interest litigation right should be given to domestic violence. At the same time, the eligibility of guardians and the application for personal protection orders should be relaxed in order to truly protect the rights and interests of women who are victims of violence.
