论我国代孕行为合法性的确认

【摘要】：代孕自从其出现之后,实务界和学术界一直对其争议不断。尤其在我国,法律明确规定禁止医疗机构和医务人员实施代孕技术。但是,代孕行为有其存在的合理性,本文通过分析代孕行为的若干特性,肯定其合理性,进而以期保护代孕过程中相关当事人的合法权益。本文共分为六部分。第一部分是引言,介绍代孕的相关背景。第二部分是代孕的概念。从各种对代孕的定义出发,得出代孕的概念,从而为论证代孕行为合理性奠定前提。第三部分是各国立法例和我国现状,通过国外对代孕立法例以及我国的香港地区、台湾地区和大陆地区的立法现状,寻找在我国承认代孕行为的法律支撑。第四部分为代孕行为合理性研究,从生育权、身体权和公序良俗原则三个方面探讨代孕行为的合理性。第五部分为代孕行为合法化的制度设计,从代孕行为的资格条件,代孕母亲与代孕婴儿关系,以及代孕孩子的知情权三个方面解决代孕行为中出现的问题,倡导在我国建立《代孕行为法》。第六部分结语,本文的结论是承认代孕行为的合法性,并建议进行相关立法保护相关当事人权利。
[Abstract]:Since its emergence, surrogacy has been controversial in practice and academia. Especially in China, the law explicitly prohibits medical institutions and medical personnel from implementing surrogate technology. However, surrogacy has its own rationality. This paper, by analyzing some characteristics of surrogate behavior, confirms its rationality in order to protect the legitimate rights and interests of the relevant parties in the process of surrogacy. This paper is divided into six parts. The first part is the introduction, introducing the related background of surrogate pregnancy. The second part is the concept of surrogacy. Starting from various definitions of surrogacy, the concept of surrogacy is obtained, which lays the premise for the rationality of surrogate behavior. The third part is the legislation of various countries and the current situation of our country, through the foreign legislation of surrogacy legislation and China's Hong Kong, Taiwan and the mainland region of the legislative status quo, looking for legal support for the recognition of surrogacy in our country. The fourth part discusses the rationality of surrogacy behavior from three aspects: reproductive right, body right and the principle of public order and good custom. The fifth part is the system design of legalization of surrogacy, which solves the problems in surrogacy from three aspects: the qualification of surrogacy, the relationship between surrogate mother and surrogate baby, and the right to know about surrogacy. Advocate the establishment of surrogate behavior law in our country. In the sixth part, the conclusion of this paper is to recognize the legality of surrogacy, and to recommend the relevant legislation to protect the rights of the parties concerned.
