论离异家庭未成年人财产权利及保护

【摘要】：随着人们生活水平的提高,家庭财富也日益增长,亲子间的财产关系必然也法生了变化,趋于复杂化。例如子女接受他人的赠与和拾得遗失物以及子女凭借自身劳动能力而从事职业获得报酬等情况,而对于这些财产,未成年人父母能否加以管理以及拥有何种权利需承担何种义务等在婚姻法中未进行明确系统的规制。当前,我国虽已建立了未成年人基本法律保护体系,未成年人受抚养、受教育等权利有了较为明确的规定,但在未成年人财产权保护方面却存在立法上体系散乱、条文多为原则性规定,内容过于抽象等缺陷。从有关婚姻家庭法方向研究学者的学术专著和期刊论文中,我们可以发现对于离异家庭未成年人财产权利及保护制度方面的关注不是很多,学者们关注更多的是未成年子女监护抚养问题,若是有提及此问题也并无设专章具体详尽的论述,总体上比较滞后。保障离异家庭未成年子女的财产权利是保障其今后生活的首要基础,但离异家庭未成年子女财产权利保护问题是目前我国民法、婚姻家庭法的一个立法薄弱点,相关规定不完备。遂本文拟从我国对离异家庭未成年子女财产权利立法缺陷出发,结合域外相关法律规定,试提出完善有关我国离异家庭未成年子女财产制度立法的相关建议和举措。
[Abstract]:With the improvement of people's living standard, family wealth is increasing day by day, and the property relationship between parents and children will inevitably change and become more complicated. For example, in the case of children receiving gifts from others and picking up lost property, and if their children are paid for their work by virtue of their ability to work, and in the case of such property, Whether the parents of minors can be regulated and what kind of rights and obligations should be assumed are not regulated systematically in the Marriage Law. At present, although China has established a basic legal protection system for minors, the rights of minors' maintenance and education have been clearly stipulated, but in the protection of minors' property rights, there is a scattered legislative system. The provisions are mostly in principle, and the contents are too abstract and so on. From the academic monographs and journal papers of scholars on the direction of marriage and family law, we can find that there is not much concern about the property rights and protection system of minors from divorced families. Scholars pay more attention to the problem of custody and maintenance of minor children. The protection of the property rights of minor children in divorced families is the primary basis for their future life. However, the protection of the property rights of minor children in divorced families is a weak point of legislation in China's civil law and marriage and family law at present. The relevant regulations are incomplete. Therefore, this article intends to set out from our country to divorce family minor child property right legislation flaw, unifies the extraterritorial correlation law stipulation, tries to propose the consummation regarding our country divorce family minor child property system legislation related suggestion and the measure.
