韩国成年监护制度解析

【摘要】：2011年《韩国民法典》经修订确立了成年监护制度体系,采纳区分类型保护模式。成年监护包括法定监护和意定监护。法定监护区分为成年监护、限定监护和特定监护三种类型,它们的差异主要体现在监护人的职权范围与时间的持续性上,家庭法院法官根据被申请人的精神状态和具体利益选择对其最为有利的监护方式。在意定监护方面,为保障被监护人的利益,韩国民法设置了较多的强制性规定。韩国的成年人监护立法,强调对老年人自由与权利的尊重,从传统的“消极防御保护”转到“积极辅助”老年人实现对自己事物处理的意愿上;强调公权力对弱势群体个人利益的保护,扩张了家事法院对成年监护的全程护航;同时肯定成年监护服务的市场化方向。
[Abstract]:The 2011 Korean Civil Code established the system of adult guardianship and adopted the model of differential type protection. Adult guardianship includes statutory guardianship and consensual guardianship. Legal guardianship is divided into three types: adult guardianship, limited guardianship and specific guardianship. According to the mental state and specific interests of the defendant, the family court judge chooses the most favorable guardianship mode. In order to protect the interests of the ward, Korean civil law has set up more mandatory regulations. South Korea's adult guardianship legislation, emphasizing respect for the freedoms and rights of the elderly, from the traditional "negative defense protection" to "actively assist" the elderly to achieve the will to deal with their own affairs; The emphasis on the protection of the personal interests of the disadvantaged groups by the public power has expanded the protection of adult guardianship by the Family Court and affirmed the market-oriented direction of the adult guardianship service at the same time.
