关于婚姻法定位与立法完善的思考——以民法典的制订为契机

【摘要】：进入21世纪之后,我国已经将制订一部统一的民法典的工作提上重要议事日程,民法的法典化为婚姻法的完善提供了很好的机会,同时也再度引发了关于婚姻法立法定位的争论。现以我国民法典的制订为契机,总结在历史的不同时期以及不同的法律体系中婚姻法与民法的关系,分析婚姻法与民法的区别与联系,在此基础上提出完善婚姻家庭制度的一些思考,以期对构建我国健全的婚姻法体系有所裨益。
[Abstract]:After entering the 21st century, China has put the work of making a unified civil code on the agenda. The codification of the civil law provides a good opportunity for the perfection of the marriage law. At the same time, it also triggered a debate on the legislative position of marriage law. Taking the formulation of civil code of our country as the turning point, this paper summarizes the relationship between marriage law and civil law in different historical periods and different legal systems, and analyzes the difference and relation between marriage law and civil law. On this basis, the author puts forward some thoughts on how to perfect the marriage and family system in order to benefit the construction of a sound marriage law system in our country.
