解决“黑户”问题的人权视野与法治维度

【摘要】：获得户口登记直接涉及个人人格和身份应获保障的基本人权,而"黑户"问题的存在使得很多公民的这项权利得不到有效保障。造成"黑户"问题的主要原因既与户口制度本身的性质有关,更与地方政府为户口登记设置不合理条件存在莫大关系;同时,政策治理模式也导致了治理"黑户"问题的实际效果非常不理想。2016年国务院办公厅发布的《关于解决无户口人员登记户口问题的意见》对于提高我国人权保障水平具有重要意义。但是,要彻底解决"黑户"问题,还有必要在户口登记制度中引入人权视角,通过修订《户口登记条例》进一步提高户口制度的法治化水平。
[Abstract]:The acquisition of household registration is directly related to the fundamental human rights that the personality and identity of an individual should be safeguarded, However, the existence of the problem of "household registration without registration" has left many citizens without effective protection of this right. The main reason for the problem of "household registration without registration" is related to the nature of the hukou system itself. There is also a great deal of relationship between the unreasonable conditions set by local governments for household registration; at the same time, The policy governance model has also led to a very unsatisfactory actual effect on the problem of "household registration without registration". In 2016, the General Office of the State Council issued the "opinions on solving the problem of registered hukou without hukou" for improving the protection of human rights in China. Equality is important. But, In order to solve the problem of "household registration without registration", it is necessary to introduce a human rights perspective into the household registration system, and to further improve the rule of law level of the household registration system by revising the regulations of household registration.
