政府信息公开中的保密审查制度研究

【摘要】：随着行政政府向服务政府转型深入，各国政府正积极推进政府信息公开，建立透明政府、阳光政府成为世界主流趋势。信息保密审查机制作为政府信息公开制度中不可缺少的重要环节，在政府主动公开和依申请公开的信息中，哪些涉及国家秘密、如何认定、认定程序、定密错误后处理程序都是政府信息公开制度的重要问题。保密审查机制为政府信息公开与保密划清具体界限，也直接影响着政府信息公开制度发展。在我国长达两千年的封建制度下，“法藏于府，威严莫测”的政治传统深入社会各个阶层，政府机关在大众眼中披着神秘面纱。随着法治社会理念的传播，建立法治政府，依法治国成为我国政府执政目标，政府信息公开制度得以建立和实施，《中华人民共和国政府信息公开条例》（以下简称《条例》），标志着政府信息公开制度在我国初步建立。《条例》中，明确政府信息含义，政府信息公开范围，规范政府信息公开程序、方式，并特别规定保密审查制度、监督和相关保障制度等内容。《条例》实施后，在中央政府的大力推动下，各级地方政府均作出积极的响应，根据《立法法》规定,我国共有80个地方政府有权制定地方性法规或地方政府规章(以下简称为地方规定)。在《条例》制定前,截至2006年11月15日，共有34个地方专门制定信息公开地方规定。《条例》公布以来，，8个已经制定地方规定的对原规定依据《条例》进行相应的修订。这种成果是鼓舞人心的，也是我国行政理念转变的具体表现，但是随着《条例》实施的时间增长，社会实际情况的变化，一些在立法层面和制度层面的缺陷和不足日益凸显。

After the implementation of regulations, vigorously promote the central government and local governments at all levels to make a positive response, according to the provisions of the legislation law, there are 80 local governments have the right to formulate local regulations or local government regulations (hereinafter referred to as local regulations).
