试论民间文学艺术的法律保护

【摘要】：随着经济全球化的发展,文化全球化的趋势也越来越明显,各种文化之间不断交流、融合、碰撞。而民间文学艺术这一文化瑰宝却没有得到应有的重视,以致于民间传统文学艺术被滥用,民间文学艺术传承后继乏人,发展中国家的民间文学艺术被无情攫取,这些都使得保护民间文学艺术刻不容缓。文章从界定民间文学艺术的概念着手,阐述对民间文学艺术进行法律保护的必要性和可行性,通过借鉴国外以及国际组织保护民间文学艺术作品的立法现状以及各种法律保护建议,分析了我国在法律层次上进行民间文学艺术保护所要面对的主要问题。提出关于建立专门的立法保护模式的初步思路。希望能够通过专门立法这一保护模式使得民间文学艺术能够重新焕发生机,进一步维护世界文化多样性。
[Abstract]:With the development of economic globalization, the trend of cultural globalization is becoming more and more obvious. Various cultures are constantly communicating, merging and colliding. However, folk literature and art, as a cultural treasure, have not received the attention they deserve. As a result, folk traditional literature and art have been abused, folklore and arts have not been inherited, and folk literature and art in developing countries have been ruthlessly seized. All these make it urgent to protect folklore. This paper begins with defining the concept of folklore and expounds the necessity and feasibility of legal protection of folklore. Through drawing lessons from foreign and international organizations to protect folklore and art works of the legislative status and various legal protection proposals, This paper analyzes on the main problems to be faced in the protection of folklore and art on the legal level in our country, and puts forward some preliminary ideas on the establishment of a special legislative protection model. It is hoped that the protection model of special legislation can make. Folk literature and art can be revitalized again. Further safeguard the cultural diversity of the world.
