以法治思维构建执行力政府

【摘要】：执行力政府是我国政府适应社会经济新形势推进行政改革的新思路。随着政府改革进程的不断深化，新一届政府对于政府职能转变、行政管理体制改革提出了更高要求。文章从法学理论以及宪法与行政法角度，对当前政府的施政纲领、具体政策进行理论透析，通过比较分析国内外政府改革的现有成果，对执行力政府的构建提供理论制度建议。随着法治思维是中国共产党对我国政府官员依法行政提出的新目标。在我国，法治政府一直是我国政府的方向以及行政法的研究热点，法治思维则是实现法治政府的思想基础，没有法治理念、不具备法治思维如何实现法治政府？缺乏理论指导的实践是盲目的、不科学的。笔者尝试将二者结合，提出从法治思维的角度提出构建执行力政府的具体思路。本文共分三部分。第一部分提出了“执行力政府”的概念。从法学理论角度论证了执行力政府的合理性，从中外政府演进历程展现出执行力政府的创新性，从实现中国梦的角度体现了执行力政府的必要性。第二部分介绍了我国法治思维的发展情况以及法治思维的概念，主要论述了法治思维对执行力政府的基本要求。运用“平衡论”界定执行力政府与市场、个人利益、相对人的关系。第三部分提出了构建执行力政府的路径选择。从转变政府职能、改革行政管理体制方面，提出建立“创新政府”；从法律法规的健全完善与有效适用方面，提出建立“法治政府”；从完善政绩考核评价体系角度，提出构建“高效政府”。
[Abstract]:Executive power government is a new way for our government to adapt to the new social and economic situation to promote administrative reform. With the deepening of the process of government reform, the new government changes the functions of the government. The article, from the angle of law theory, constitution and administrative law, analyzes the current government's policy program and concrete policies, and analyzes the existing achievements of the government reform at home and abroad. As the thinking of rule by law is the new goal that the Communist Party of China put forward to our government officials to administer according to law. In our country, the rule of law government has always been the direction of our government and the research hotspot of administrative law. The thinking of rule of law is the ideological basis of realizing the government by law. Without the idea of rule of law, how to realize the government by law without thinking of rule of law? The lack of theoretical guidance in practice is blind and unscientific. The author tries to combine the two and put forward the concrete idea of constructing executive power government from the perspective of the rule of law thinking. This paper is divided into three parts. The first part puts forward the concept of "executive power government", demonstrates the rationality of executive government from the angle of law theory, and shows the innovation of executive government from the evolution course of Chinese and foreign governments. The second part introduces the development of the rule of law thinking and the concept of the rule of law thinking in China. This paper mainly discusses the basic requirements of the rule of law thinking to the executive power government, uses the "balance theory" to define the executive power government, the market, the personal interest, The third part puts forward the path choice of constructing executive power government. In the aspect of transforming government function and reforming administrative management system, it puts forward the establishment of "innovative government", the perfection and effective application of laws and regulations. This paper puts forward the establishment of "government by law" and the establishment of "efficient government" from the angle of perfecting the evaluation system of political achievements.
