我国文化体制改革法律问题初探

【摘要】：作为一个国家核心竞争力的组成部分,文化软实力是一个国家和民族精神力量的集中体现,其竞争力和影响力影响着一个国家和民族综合国力的高低。促进文化发展,实现文化强国,不仅是满足广大人民群众文化需求,适应经济全球化的要求,更是实现中国梦的要求。 促进文化发展,实现社会主义文化大发展、大繁荣离不开法律的保障。建设社会主义法治国家本身要求文化领域治理方式的转变,完善的文化法体系亦是建设社会主义文化强国的必要保障。我国文化体制改革同样离不开法律的支持,通过法律的规范作用、强制作用、指引作用、教育作用、评价作用,促进文化体制改革的依法扎实有序推进。文化产业体制和文化事业体制虽不能涵盖文化体制的全部,但是却是在我国文化体制中极为重要的两个方面。一方面,文化产业对于促进我国经济转型,创造就业岗位,拉动经济增长方面具有重要意义,而公益性、社会性的特点决定了文化事业建设也绝不能被忽视。 改革开放以后,伴随着我国经济发展和人民生活水平的提高,文化产业的重要性越来越被人们所重视,我国的各级立法部门对于文化产业方面的立法无论是实体法还是程序法方面都做出了大量有益尝试,初步建立起了文化方面的法律框架。但是,在立法结构的合理性,立法细节的把握,以及传统立法认识与现代立法理念的冲突方面仍有很多亟待完善之处。在以经济建设为中心的当代中国,公共文化事业很容易沦为文化产业的附庸。对于经济利益的追逐则会导致强调公益性的文化事业建设的迟滞,这其中就包括文化事业建设当中的立法缺失现象。此外,文化虽然具有民族性,但不能固步自封。在全球化趋势不可逆转的前提下,学习和借鉴国外文化体制建设当中的有益经验,是激发本民族文化生机与活力,提高本国文化软实力和综合竞争力的必然选择。
