行政规范性文件变更下公民合法预期保护

【摘要】:在我国当前转型时期,上位法律规范的变更因客观情况的变化致使行政规范性文件有时常发生变更的必要。而一旦发生变更,如何面对未变更之前公民对旧有法律秩序的信任以及因信任而采取的行动,同时,若行政法律规范文件随意变更,则极易造成公民因信赖先前行政规定而有所作为但却遭致无法预见损害的不利后果。这个问题具有现实性,一方面根据客观情况的变化,行政机关为了有效率执行变更后的政策不得不变更原有的规范性文件;但另一方面,相对人的合法预期又会受到潜在的威胁,而法律必须兼顾到相对人的利益对其进行保护。这使得二者之间不可避免地发生了生了冲突。这实质上体现了我国在改革发展中如何协调发展和稳定的关系。这个问题在法学上则体现为如何在合法预期保护原则和行政机关变更规范性文件的自由裁量上寻求一个平衡的问题。因此把行政规范性文件变更下如何为公民提供合法预期保护作为本文的重点。本文分为四个部分: 第一部分开篇介绍了何谓行政规范性文件以及它的性质和法律效力,然后论述行政规范性文件变更的含义以及从立法学的角度将行政规范性文件的变更分为几种类型并对各种类型作了具体分析。 第二部分主要阐述引入合法预期保护的必要性。首先对什么是合法预期作了介绍,然后具体地论述合法预期保护的起源和发展;其次,对合法预期保护进行法理分析。从法治与法的安定性原则、行政自我约束原则和平等原则、个人自治和平等原则以及行政行为的效力的判定与合法预期保护的关系四个方面着手进行分析。 第三部分主要讲述我国立法对合法预期保护的不足。这部分重点阐述信赖保护原则的缺陷和我国现有法律的保护标准具有模糊性。 最后一部分,论述政规范性文变更下公民合法预期保护的具体方式。首先介绍行政规范性文件变更中合法预期的适用条件以及预期保护的例外。然后重点介绍合法预期的三种保护方式:程序性保护、实体性保护和补偿保护。
[Abstract]:In the current transition period of our country, the change of the upper legal norms is necessary because of the change of the objective circumstances, and once the change occurs, it is necessary to change the administrative normative documents. How to face the trust of citizens in the old legal order before the change and the action taken because of trust, and at the same time, if the administrative legal norm document is changed at will, It is highly vulnerable to the adverse consequences of citizens acting by relying on previous administrative regulations but suffering unforeseeable damage. This question is realistic, on the one hand, based on changes in objective circumstances, In order to carry out the changed policies efficiently, the administrative organs have to change the original normative documents; on the other hand, the legitimate expectations of the relative parties will be potentially threatened. The law must take into account the interests of the relative person to protect them. This makes the conflict between the two inevitable. In essence, it reflects how to coordinate development and stability in the reform and development of our country. How to find a balance between the principle of legal expected protection and the discretion of administrative organs to change normative documents. Therefore, how to provide citizens with administrative normative documents under the change of administrative normative documents. This paper is divided into four parts:. The first part introduces what is an administrative normative document and its nature and legal effect. Then it discusses the meaning of the change of administrative normative document and classifies the change of administrative normative document into several types from the angle of legislation and makes a concrete analysis of each type. The second part mainly expounds the necessity of introducing legal anticipatory protection. Firstly, it introduces what is legal expectation, and then discusses the origin and development of legal anticipatory protection in detail. From the principles of the rule of law and the stability of the law, the principle of administrative self-restraint and the principle of equality, The relationship between the principle of individual autonomy and equality and the validity of administrative action and the legal expected protection is analyzed. The third part is mainly about the deficiency of the legislation of our country to the legal expected protection, which focuses on the defects of the principle of trust protection and the fuzziness of the protection standard of the existing law of our country. The last part, This paper discusses the concrete ways of the citizen's legal expected protection under the change of the administrative normative document. Firstly, it introduces the applicable conditions of the lawful expectation and the exception of the expected protection in the change of the administrative normative document. Then, it focuses on the three kinds of the lawful expectation. Mode of protection: procedural protection, Substantive protection and compensation protection.
