试论人工辅助生殖技术引发的法律问题

【摘要】：将人工辅助生殖技术运用到临床技术中给不孕不育患者带来了诸多福利,提升其生活质量,但这在客观上对人类绵延已久的繁衍方式带来了冲击,引发了诸多的伦理道德和法律问题,不论是从国内立法或者是国际私法的层面都令人棘手。促进人工生殖技术更好地规范与管理,全世界都以不同的立法形式制定了相应的规则与制度。我国目前人工辅助生殖技术的立法,全部都是以卫生部规章的形式出现,尚未上升到法律层面,影响了对人工生殖技术的调控。由于利益驱使和刚性需求,精子、卵子、胚胎非法买卖、同精多孕、非法鉴别胎儿性别、非法多胎移植生育、非法代孕等逐渐突出,对伦理道德以及基本社会稳定造成了一定的威胁。法律规制是人工辅助生殖技术有效管理的最佳模式,其一,要提高立法级别,健全相关法律体系,适时推出《人工辅助生殖法》;其二,刑法要介入滥用人工辅助生殖技术的行为,增设"滥用人工辅助生殖技术罪"。
[Abstract]:The use of artificial assisted reproductive technology in clinical technology has brought many benefits to infertile patients and improved their quality of life, but this has brought about a lot of ethical and legal problems, both from domestic legislation and the level of private international law. Hand. Promoting the better standardization and management of artificial reproduction technology, the relevant rules and systems have been formulated in different legislative forms all over the world. All the legislation of artificial assisted reproductive technology in China is currently in the form of the Ministry of health regulations, which has not risen to the legal level, and has influenced the regulation of artificial reproductive technology. The legal regulation is the best model for the effective management of the artificial assisted reproductive technology.
