【摘要】：哈萨克族民间文学艺术作品是指无法确定具体作者,不过有充足情由可以推定是由哈萨克族群体或部落创作并经历了世世代代的传承与发展完善,表现哈萨克族生活特点与文化魅力的民间文学艺术的具体表现形式,如民间文学、民间音乐与舞蹈等。哈萨克族是一个拥有悠长历史与灿烂文明的民族,创造了丰富多彩、富含意义的传统民族文化,形成了充实的、体现民族才华和智慧的民间文学艺术作品。哈萨克族民间文学艺术作品法律保护中存在很多不足之处,如果不及时提供有效地法律保护,许多优秀的传统民族文化或许会永久的消失。本文以哈萨克族民间文学艺术作品保护现状中存在的问题与不足出发,探讨如何在法律层面上有效地进行保护与完善,从而保障包括哈萨克族在内的我国民间文学艺术作品得到良好的发扬与传承。本文主要由以下几部分组成:第一部分是对哈萨克族民间文学艺术作品的概述。首先从民间文学艺术作品的概念、与相似概念的区别、范围界定等方面的基本理论做简单概述。然后在此基础上介绍哈萨克族民间文学艺术作品的概念、种类、特点、价值与保护的必要性。第二部分是民间文学艺术作品在国际上的相关规定及我国的立法状况。首先归纳分析民间文学艺术作品保护问题在有关国家、有关国际间,区域间条约和国际组织间的相关规定。其次在国家与地方立法层面上研究分析我国在民间文学艺术作品保护问题上的态度、做法与立法趋势。第三部分是哈萨克族民间文学艺术作品保护的现状及表现出的不足。根据实践中存在的哈萨克族民间文学艺术作品侵权纠纷实例出发,结合不同种类民间文学艺术作品的保护现状,分析归纳所存在的问题。第四部分中从哈萨克族民间文学艺术作品保护存在的不足为出发点,结合国内现状,对我国民间文学艺术作品的法律保护提出完善措施,主要包括:对民间文学艺术作品知识产权保护的立法提出完善建议、设立全面的私法、公法共同保护机制、设立合理的数据库与利益分享机制、加强法制宣传教育,培养法律专业人才、加强国际上的知识产权合作等方面。
[Abstract]:Kazakh folk literature and art works refer to the fact that it is impossible to identify specific authors, but there is sufficient reason to presume that they were created by Kazakh groups or tribes and experienced the inheritance and development for generations to come. The specific forms of folk literature and art, such as folk literature, folk music and dance, which represent the characteristics of Kazakh life and cultural charm, are a nation with a long history and splendid civilization. The traditional national culture, which is rich in meaning, has formed rich folk literature and art works that embody national talent and wisdom. There are many deficiencies in the legal protection of Kazakh folk literature and art works. If effective legal protection is not provided in time, many excellent traditional national cultures may disappear forever. This paper starts with the problems and shortcomings in the protection of Kazakh folk literature and art works. To explore how to effectively protect and improve on the legal level, This paper mainly consists of the following parts: the first part is an overview of Kazakh folk literature and art works. Starting with the concept of folklore, On the basis of this, the author introduces the concept, category and characteristics of Kazakh folklore and art works. The second part is about the international regulations of folklore and the legislative situation of our country. Firstly, it summarizes and analyzes the protection of folklore works in the countries concerned and the international community. The relevant provisions of interregional treaties and international organizations. Secondly, at the level of national and local legislation, the attitude of our country on the protection of folklore and art works is studied and analyzed. The third part is about the present situation of the protection of Kazakh folk literature and art works and their shortcomings. Combined with the current situation of the protection of different kinds of folk literature and art works, this paper analyzes the existing problems. Part 4th, from the point of view of the shortcomings of the protection of Kazakh folk literature and art works, combines the present situation of our country. This paper puts forward some perfect measures for the legal protection of folklore and art works in our country, which mainly include: making perfect suggestions on the legislation of intellectual property protection of folklore and art works, establishing a comprehensive mechanism of private law and public law joint protection. Setting up reasonable database and benefit sharing mechanism, strengthening legal publicity and education, training legal professionals, strengthening international cooperation in intellectual property rights and so on.
